גישה מוסדית לביקורת השיפוטית <br>(Institutional Approach to Judicial Review)

Abstract

תקציר בעברית: מאמר זה מציג את הגישה המוסדית לביקורת השיפוטית, אשר שמה דגש על שקילת העיצוב המוסדי של הרשויות המנהליות המעורבות בקבלת ההחלטה השלטונית, וסוקר את יתרונותיה וחסרונותיה. באמצעות שני מקרי מבחן המאמר בוחן את המידה והאופן שבהם ערכאות הביקורת השיפוטית בישראל שוקלות שיקולים מוסדיים בעת שהן בוחנות את חוקיותן של החלטות גופי הרשות המבצעת. בהתבסס על מקרי המבחן האמורים נטען כי הביקורת השיפוטית בישראל עוסקת בניתוח מוסדי, אך לעיתים בצורה חלקית וחסרה. על רקע אמור מוצע להרחיב את התמונה המוסדית המוצגת לבית המשפט על-ידי הצדדים בדרך של שיקוף מוסדי ובמקרים המתאימים לכך אף לשלב בביקורת השיפוטית כלי דיוני חדש – תסקיר מוסדי – שעיקרו סקירה של העיצוב המוסדי של הרשויות המינהליות שקיבלו את ההחלטה העומדת לביקורת ושל התהליך שהוביל לקבלת ההחלטה. זאת, כדרך לסייע לביקורת השיפוטית לשקול שיקולים מוסדיים בצורה נכונה ומלאה וכאמצעי לקדם תהליך חשיבה רפלקסיבי ביחס לעיצוב המוסדי של המדינה המנהלית. English Abstract: The article presents an approach to judicial review. This approach focuses on the extent to which judicial review considers the design of the relevant administrative authorities involved in the decision-making process, and examines its benefits and flaws. Based on two case studies, the article examines the extant and the way in which judicial review in Israel take considerations into account when examining the legality of decisions taken by executive bodies. Based on the above-mentioned case studies, I suggest that even though judicial review in Israel take factors into consideration, it often does so in an incomplete and flawed way. It is against this background that I suggest that the design presented by the parties in court be broadened by means of an “institutional representation”. In certain cases, this should include a novel tool which I call institutional assessment - a survey of the design of the relevant administrative authorities which received the decision under review, and of the underlying processes which brought about the decision. This tool will foster the adoption of broad and comprehensive set of considerations which will promote a reflexive thinking process regarding the design of the administrative state.
