Abstract
With the advancement of digitalization of labor and the spread of flexible working hours, including telecommuting, the boundaries between work and life (rest) of workers have become blurred. This is because it is possible to provide labor that transcends time and space. In this changing environment, workers are demanding the exercise of self-determination over working hours. By actively using information and communication technology (ICT) and flexible working hours (selective working hours, discretionary working hours, telecommuting, etc.) stipulated in the Labor Standards Act. It is hoping that work and life (home or self-development) will be compatible (the active demand of the generation with strong self-sufficient values).<BR> The right to self-determination granted to workers is a basic right guaranteed by the Constitution. Therefore, workers’ right to self-determination should be guaranteed even in the area of working hours under the Labor Law. This premise also applies to the selective working-time system stipulated in the Labor Standards Act and telecommuting (working-time outside the workplace), a new form of work in the era of‘Post COVID’.<BR> It is applied uniformly. In this article, I would like to explore the basis for workers’ self-determination of working hours and methods of guaranteeing them, and ways to enable home work, a new form of work that transcends time and space, to be settled in the workplace.
