Abstract

The concept of the irrational in legal science is analyzed. It is noted that the irrational permeates the entire legal sphere. Particular attention is paid to the concept of legal mentality. The author turns to the cognitive experience of the School of the Annals, which emphasizes in her methodology the importance of determining the environment, which includes not only spiritual culture, but also nature, technology, types of property, etc. The study of “living law” is the most important task of modern legal science.
