Abstract

Housing is required to have habitability for a comfortable living. The directive and effective way for habitability is to establish law which control new construction and housing management. Housing Act that having detailed regulation for habitability is applied to only more than thirty housing construction. Other housing construction is applied Building Act. Building Act basically seek building safety, it does not seek habitability actively. Actually most housing which lack habitability were constructed by Building Act. And there is no provision in law to give measures to correct for existing housing which having not habitability. So for habitability it is need to establish law system that having adequate housing standard, and it should control new housing construction and existing housing for habitability. It is desirable that Housing Act take charge of the major role. Housing standard that is composed provisions for habitability should applied to all housing and housing facility that is not classified as housing but using as dwelling. Gosiwon and Officetel should be integrated into housing so as to apply housing standard. Enforcement fine should be levied on constructor also who remodeled illegally neighborhood convenience facilities for dwelling. And illegal neighborhood convenience facilities should not be legalized by cyclic legalization. To protect tenants from inadequate rental housing, it is desirable to seek using private law system.
