Abstract

This article is devoted to the analysis of the approach to understanding the figure of the escrow agent according to philosophical ideas that dominated social thought during the origin and development of the institution of escrow. An escrow agent is a key element of the escrow institution. In this regard, it seems reasonable to first of all turn to the essence of this legal category. For this purpose, the author of the article provides a historical excursion into the period of development of the institution of escrow, analyzes key philosophical works of the corresponding period, and also concludes that the evolution of understanding the figure of an escrow agent as a particular example of an economic and legal category coincides with the evolution of philosophical ideas about the figure of an intermediary.
