أثر الإشکال في اختلاف الفقهاء دراسة فقهية ربيع محمد محمد عبد الرحمن . قسم الفقه العام ، کلية الشريعة والقانون ، الجامعة الإسلامية بهانج السلطان أحمد شاه ، ماليزيا. البريد الألکتروني : rabie@kuipsas.edu.my rabimohamed290@yahoo.com ملخص البحث:- للمشکل أثر في اختلاف الفقهاء وتکوين الفقه الإسلامي ونشأة المدارس الفکرية المتعددة بمرجعيتها الفقهية؛ لذا کان من تعربفات الأصوليين للفقه استنباط حکم المشکل من الواضح، والتفقه استنباط علم الأحکام وتتبعها من طريق الاستدلال؛ ولوجود المشکل في النص أو في ذهن المجتهد نتج الاختلاف الفقهي في استنباط الحکم؛ لهذا اخترت أن أکتب في (أثر الإشکال في اختلاف الفقهاء دراسة فقهية) خاصة المسائل التي صرح بالإشکال فيها المصنفون، سائلا الله فتحه؛ لأن معرفة الإشکال علم في نفسه وفتح من الله تعالى، متبعا منهج الاستقراء، وکانت مشکلة البحث في کيفية رفع الإشکال والترجيح بين الأقوال. الکلمات المفتاحية: أثر، الإشکال ، اختلاف ، الفقهاء ، دراسة. E-MAIL: rabie@kuipsas.edu.my rabimohamed280@yahoo.com Abstract: The effect of ambiguity on the different opinions of scholars, the formation of Islamic jurisprudence (fiqh), and the emergence of multiple schools of thought with their jurisprudential references. Therefore, among the fundamentalists ’definitions of jurisprudence, it was clear to deduce the ruling of the problem, and the fiqh was to devise the science of rulings and follow them through inference. And because of the presence of the problem in the text or in the mind of the mujtahid, the jurisprudential difference resulted in the deduction of the ruling. That's why I chose to write in this topic. Therefore, among the fundamentalists ’definitions of jurisprudence, it was clear to deduce the ruling of the problem, and the fiqh was to devise the science of rulings and follow them through inference. And because of the presence of the problem in the text or in the mind of the mujtahid, the jurisprudential difference resulted in the deduction of the ruling.
