Abstract

The article examines the issue of determining the legal regime of property of persons in an unregistered marriage. The authors analyze law enforcement practice, including the position of the Supreme Court of the Russian Federation, on resolving property disputes between cohabitants, consider foreign experience in the legal regulation of these relations. The statistical materials presented in the paper illustrate the popularity of cohabitation relations in the Russian Federation, and sociologists' research reveals the possible reasons for the reluctance of persons to enter into marital relations registered in the manner prescribed by law. The authors support the need to take state family policy measures aimed at preserving and strengthening traditional family values, improving the institutions of family and marriage.
