Державне регулювання господарських відносин у діяльності морських портів

Abstract

The article provides a theoretical analysis of the essence of state regulation of economic relations in the activities of seaports. It has been established that the normative regulation of economic relations in the activities of seaports is provided by a large number of regulatory legal acts, among which the Law of On the seaports of Ukraine occupies a central place, which fixes the seaport management system, regulates the legal regime of property in the field of the port industry, determines the main forms of public-private partnership in the port industry. The groups of subjects of economic relations in the seaports have been determined, including state and local authorities, exercise economic powers in the seaport; port economy entities, which are entities operating in the seaport; subjects of the port authority, endowed with economic powers, ensure the operation of seaports and exercise the management of seaports and their officials; business entities as consumers of port services / works. It has been proved that state regulation of economic relations in seaports should be carried out through the implementation of specific principles, namely: equality of rights of all business entities operating in the seaport; preservation of strategic objects of the port infrastructure of the seaport in state ownership; ensuring economic competition in the seaport. In order to improve the efficiency of economic activity and profitability of ports, as well as to respond promptly to changes in demand, it was proposed: to determine the requirements for regulatory support and generalize the issues that need to be considered when developing a strategy for reforming ports; to create a system of state regulation of the economic activity of seaports; to formulate an institutional strategy for creating an organizational and economic structure of seaports and opportunities for performing the relevant regulatory functions; select the appropriate regulatory methods and instruments within the range of reform options and conditions of competition in economic relations in the activities of seaports; to develop recommendations for modernizing the system of state regulation of economic relations in the activities of seaports.
