Abstract

The purpose of this scientific article is to identify the features of assessing the admissibility and reliability of forensic medical examinations as evidence, assessment of unacceptable and unreliable conclusions of an expert in judicial decisions. The authors give examples of unacceptable and unreliable expert opinions. Evaluation of reliability of expert conclusions includes checking the completeness of the conducted research, the correctness of the choice of the research methodology, and the methods themselves, the completeness of the conclusions drawn by the expert, the validity of the conclusions, and the completeness of the investigated objects. Assessment of the admissibility of an expert opinion includes inconsistency of the contents of the expert opinion with the current legislation; non-compliance with the established procedure of the examination; lack of appropriate qualification of the expert who conducted the examination; wrong choice of the object for research. The results of the study can be used by the investigative and judicial authorities in investigating and hearing of criminal cases.

Introduction

Целью научной статьи является выявление особенностей оценки допустимости и достоверности заключения судебно-медицинских экспертиз как вида доказательств, оценка недопустимых и недостоверных выводов эксперта в судебных решениях. Проведенное нами исследование показывает, что при производстве судебно-медицинских экспертиз эксперты допускают ошибки, которые исключают возможность использовать в доказывании данное ими заключение, поскольку нарушаются как требования допустимости заключения эксперта, так и требования достоверности.
