Abstract

A study of the peculiarities of civil liability for damage caused by artificial intelligence was conducted. The special relevance of the chosen topic is emphasized, given the significant positive potential of artificial intelligence technologies and the feasibility of minimizing the negative risks of artificial intelligence use and related compensation. Therefore, the purpose of this study is to determine the specifics of civil liability for damage caused by artificial intelligence, based on the rules of law currently enshrined in the Civil Code of Ukraine and taking into account the experience of foreign countries law enforcement. The understanding, types and grounds for the application of civil liability are analyzed. In particular, the rules of law relating to tort liability are analyzed in detail. Tort liability includes liability for culpable human conduct and for other types of torts caused by things or animals. The obligation to compensate for the damage caused is related to the actions or inaction of the person or other phenomenon, if it was the cause of the damage. The possibility of applying the norms of the Civil Code of Ukraine to compensate for damage caused by artificial intelligence is considered. It is argued that the legal rules on liability for damage caused by a dangerous product are currently the only ones that can be applied to things equipped with artificial intelligence, although liability under this principle also has certain limitations that should be taken into account. The norms of European tort law that can be used to compensate for damage caused by artificial intelligence are analyzed. Ways to improve the current civil legislation of Ukraine in terms of liability for damage caused by artificial intelligence, to minimize the negative consequences of the use of these technologies in various spheres of society and the state was suggested.
