Abstract
Safety in construction industries has been emphasized since January 2022 due to enacting ‘Serious Accidents Punishment Act’, moreover illegal re-subcontract is pointed out as main cause of collapse during demolition in Gwangju on June 2021. In other words cost reduction by illegal re-subcontract caused poor construction. Therefore Government has prepared countermeasure for illegal re-subcontract on Aug. 2021, however illegal re-subcontract maybe not improved in construction field. Sub-contractors are able to reduce their risk on direct execution and to earn commission, and resubcontract can award their work without bidding, so illegal resubcontract is still beneficial for both parties. In addition, the indifference of the main contractor are also seen as the reason. This thesis examines basic judgment principal regarding illegal resubcontract under Framework Act on the Construction Industry, and we intend to suggest legislative and practical improvement plan for illegal re-subcontract.
