ЗАСТОСУВАННЯ МАТЕРІАЛЬНОГО ПРАВА У МІЖНАРОДНИХ КОМЕРЦІЙНИХ АРБІТРАЖНИХ СПОРАХ: AMIABLE COMPOSITEUR ТА EX AEQUO ET BONO (Substantive Law Application in International Commercial Arbitration Disputes: Amiable Compositor and Ex Aequo Et Bono)

Abstract

Ukrainian absract: Багато міжнародно-правових актів та переважна більшість міжнародних комерційних арбітражних правил передбачають врегулювання суперечок за допомогою amiable compositeur або ex aequo et bono. Незважаючи на повсюдність застосування двох концепцій, вони не мають єдиного визначення, яке встановлювало б чіткі межі їхньої форми та змісту. Натомість, їх суть неоднорідна і містить відбиток кожного правового середовища, яке їх застосовує. В одних юрисдикціях amiable compositeur та ex aequo et bono є синонімами, в інших - різні явища, тому важко зрозуміти всі нюанси їх юридичної структури. Ця стаття має на меті розкрити механізм вирішення спорів у міжнародних комерційних арбітражних судах за допомогою amiable compositeur та ex aequo et bono та особливостей їх неоднорідного рельєфу в різних юрисдикціях та на міжнародному рівні. English abstract: Many international legal acts and the vast majority of international commercial arbitration rules provide dispute settlements by means of amiable compositor or ex aequo et bono. Despite the ubiquity of the application of the two concepts, they do not have a single definition that would establish clear boundaries of form and content. Instead, their essence is heterogeneous and contains the imprint of each legal environment that applies it. In some jurisdictions amiable compositor and ex aequo et bono are synonyms, in others – different phenomena, therefore, it is difficult to understand all nuances of their legal texture. This article seeks to reveal the mechanism of dispute resolution in international commercial arbitration courts through amiable compositor and ex aequo et bono and peculiarities of their miscellaneous relief in various jurisdictions and on the international level.
