Abstract

The independent living movement is achieving a "major shift in thinking” when compared with the traditional service organizations including disability welfare centers, vocational rehabilitation centers, and residential facilities. Born out of the realities of life for disabled people, the movement seeks to achieve the same quality of life as Non-disabled people. At the center of this trend and movement is the person with a disability, who is at the forefront of providing person-driven services based on the principles of independent living - self-determination and choice - while removing environmental barriers that prevent disabled paeple from living independently in their communities. The Center for Independent Living, which was born out of this movement, continues to develop as a movement for the development of the lives of people with disabilities and as a service provider in the field of disabled people. Furthermore, through the civil rights movement of disabled people, they are striving to restore the essential and fundamental rights and existential freedom in their lives. This is manifested in the independence living movement, which has improved the quality of life of severely disabled people, especially those who have been confined to facilities and homes. Therefore, it is necessary to find a way through legislation in the current law for the actual settlement of independent living centers that play such a role, and this study was conducted. "The Disability Welfare Act stipulates that various necessary support services are to be provided through independent living centers to realize the independent lives of disabled people, and the details are to be determined by the Minister of Health and Welfare. However, the Enforcement Rules of the Disability Welfare Act, which were subsequently enacted, only specify the operating standards of the center, and there is no precise basis for support for the center, so the current operation and management of the center are insufficient. Through the revision of the Disability Welfare Act, independent living centers should be specified as 'independent living service providers for disabled people' and independent living centers should be defined as social welfare institutions to ensure the quality of services and support independent living for disabled people.
