زواج المسلم بغير المسلمة والآثار المترتبة عليه ( دراسة فقهية )

Abstract

إن الزواج في الإسلام عقد له مقاصده العظيمة، وغاياته النبيلة، والأسرة هي نواة الأمة وأساسها، وقد اعتنى بها الإسلام عناية فائقة تحفظ کيانها. وفي واقعنا المعاصر اليوم يقيم عدد کبير من المسلمين خارج الوطن الإسلامي لأسباب مختلفة، وقد يضطرون إلى الزواج من غير المسلمات، وهو أمر يقع کثيرا في مجتمع الأقليات المسلمة. ونظرا لأهمية البحث في فقه الأقليات الإسلامية، فقد وقع اختياري على موضوع زواج المسلم بغير المسلمة والآثار المترتبة عليه، دراسة فقهية. ومنهجي في هذا البحث سيکون وفق المنهج الفقهي الاستقرائي في دراسة المسائل الفقهية. ومن أبرز النتائج التي توصلت إليها الدراسة: أن مسائل الزواج بين المسلمين وغيرهم تشکل أهم مسائل الأحوال الشخصية للأقليات الإسلامية. تحريم نکاح المسلم للمشرکة مطلقا سواء کانت من مشرکات العرب، أو من مشرکات غير العرب، مما ينسجم تمام الانسجام مع الحرص على تحقيق مقاصد الزواج ودوام استمراره وفق المنهج الرباني الصحيح. کما أن وقوع الخلل في الظروف والضوابط المحيطة بنکاح المسلم من غير المسلمة بشکل يخرجه عن إطاره الشرعي، يلزم القول بمنعه، أو توقيفه على الأقل، سدا للذريعة ونظرا لما يترتب عليه من مفاسد کثيرة. Abstract Muslim Marriage and non-Muslim its Implications Fiqh Study Marriage in Islam has its great purposes, its noble goals, and the family is the nucleus of the nation and its basis, and has taken care of the care of Islam and the preservation of its entity. In our contemporary reality, a large number of Muslims reside outside the Islamic homeland for various reasons and may be compelled to marry non-Muslims, which is very common in the minority community. In view of the importance of research in the jurisprudence of minorities, I have chosen the subject of Muslim marriage and non-Muslim consequences, a study of jurisprudence. My method in this research will be according to the method of jurisprudential inductive study of jurisprudential issues. One of the most prominent findings of the study: that the issues of marriage between Muslims and others are the most important issues of personal status of minorities. The prohibition of a marriage to a partner at all, whether Arab or non-Arab, which is in harmony with the keenness to achieve the purposes of marriage and the continuation of the continuation according to the correct Lord's approach. And the failure of the conditions and controls surrounding the non-Muslim in a way to get rid of its legal framework, it is necessary to say preventing or arresting at least a dam for the pretext and due to the consequences of many evils.
