Abstract

The article is devoted to one of the important procedural actions of the court — explaining to the parties the right to settle the dispute peacefully. The article defines an independent and mandatory procedural action of the court as an explanation. By analyzing judicial practice, the consequences of the court explaining to the parties about the possibility of settling the dispute peacefully are revealed. The author substantiates that the active role of the court in clarifying the right to reconciliation is a necessary component of effective judicial protection, and also serves as an additional incentive for the active use of conciliation procedures.
