Abstract

This article analyses the genesis of fiduciary security transactions in ancient Spanish law and their impact on the economic activities of that time. It highlights the influence of German doctrines on fiduciary transactions and the theory of double effect on the Spanish legal system. Furthermore, it describes the evolution of views among Spanish civil law scholars regarding the essence of such security constructs.
