Abstract

The article deals with the problem of administrative discretion in the application of administrative procedural coercion measures. The author noted that not all issues can be regulated by law, and therefore, when applying coercive measures, it is necessary to take into account non-legal factors that must meet the requirements of the law and increase the effectiveness of coercion. The article presents various points of view on the concept of legal discretion, and formulates its own position on the phenomenon under consideration.
