Стан та перспективи трансформації конституційно-правового регулювання врядування в Україні.

Abstract

The article deals with the problems of the current state and prospects of transformation of constitutional and legal regulation of governance in Ukraine, which is considered as a process of systematic interaction of active participants (stakeholders) of public power and public administration.Suggestions are made about the need for innovative approaches to the transformation of public power, based on the new paradigm of governance in Ukraine – the paradigm of good governance. The author's position on the renewal of public power, governance in various spheres of modernization of the Constitution of Ukraine is offered.The characteristic of innovations of the constitutional legal regulation which is connected with the initiatives of the President of Ukraine and the Parliament of Ukraine is given.It is concluded that the current state of constitutional regulation of governance in Ukraine is characterized by the presence of considerable problems regarding the effective functioning of constitutional law institutions, systematic updating of the Basic Law. This dictates the need to determine the prospects for further transformation of the said regulation and its acceleration.The fundamental principles of constitutionalism, principles and constitutional procedures must be adhered to.The implementation of the constitutional, political and legal renewal of public power and governance in Ukraine should envisage a comprehensive transformation of the system of government in doctrinal and applied aspects. It is also expedient to define the concept of systematic renewal, modernization of the Constitution of Ukraine, without which attempts to reform the Basic Law become problematic. In an applied dimension, it is advisable to introduce a system of public monitoring and control over the functioning of public authority to modernize it using traditional and advanced electronic forms of direct democracy.
