Abstract
The article considers the legislative mechanisms of the institution of judicial discretion in the consideration of criminal cases. Based on the analysis of theoretical and legal grounds and judicial practice, the permissible limits are determined, excluding the possibility of an arbitrary approach of the court when deciding on the imposition of penalties in criminal cases, as well as problems of legal and other nature of judicial discretion that affect the quality of Russian justice, and ways to eliminate them are proposed.
