Abstract

The purpose of the proposed study is devoted to the topical issue of compensation for losses and damages to land owners and land users of forest lands as a result of their removal for needs that are not related to forestry production on the example of Ivano-Frankivsk region. Method. Forestry lands are considered to be one of the main elements of Ukraine’s economic potential. The significance of these lands is that they are one of the main means of production. In the process of direct use of forestry lands, not by their intended function, there are negative consequences in the form of losses of forestry production. Compensation for losses of forestry production is a means of ensuring the protection of forest lands and a compensatory factor for their rational use. Instead, losses to landowners and land users are a legal lever to protect land ownership and use rights. Results. In order to improve the state regulation of protection and rational use of forestry lands, theoretical and methodological aspects of land and forestry legislation within the limits of compensation for losses of forestry lands are considered; the method of calculating the amount of losses and losses of forestry production in the extraction of forest lands and their use for purposes other than forestry; the mechanism of budget formation at the expense of losses and losses of forestry lands on the example of land plots of Ivano-Frankivsk region is analyzed. Scientific novelty and practical significance. The study of methodological approaches to determine the amount of losses and losses of forestry production, which are subject to compensation for the withdrawal of land for non-forest needs in order to calculate the amount of unearned income. The application of the current standards of compensation for losses and accrual of losses of forestry production, in a market economy, will increase revenues to local budgets, which will contribute to the rational use and prevention of unjustified seizure of forest lands.
