التباعد بین الصفوف فی الجمع والجماعات زمن الأوبئة دراسة فقهیة مقارنة

Abstract

ملخص البحث: تناولت هذه الدراسة نازلة فقهية متعلقة بانتشار وهي من النوازل المتصلة بقوام الدين وعموده وهي الصلاة، فناقشت مسألة التباعد بين المصلين في الجمع والجماعات زمن انتشار الأوبئة، فبينت أحکامها، وما يتعلق بها من مسائل، مثل: حکم صلاة الجماعة في المسجد، وحکم تسوية الصف (حکم المصافة والتراص في صلاة الجماعة)، وانفراد المأموم خلف الصف. وخلصت هذه الدراسة إلى نتائج جليلة من أهمها: أن الموازنة الصحيحة في مسألة التباعد بين المصلين في الجمع والجماعات زمن انتشار الأوبئة تقتضي إقامة الشعائر التعبدية في المساجد، ولو بالعدد الذي يسقط فرض الکفاية؛ وأن للقائمين على رعاية المساجد تنظيم الجمع والجماعات فيها من حيث الإجراءات النافعة، وهذا يحقق المصلحة الدنيوية المظنونة في الحد من احتمالية العدوى، والمصلحة الدينية القطعية في المحافظة على الشعائر التعبدية في المساجد، ويدفع الضررين المترتبين على تفويتهما. Abstract: This study deals with jurisprudence related to the spread of epidemics, which is one of the calamities related to the strength of religion and its pillar, which is prayer. And the ruling on straightening the rows (the rule of alignment and grouping in group prayer), and the follower being alone behind the row. This study concluded with great results, the most important of which are: The correct balance in the issue of spacing between worshipers in the gathering and groups during the spread of epidemics requires the establishment of devotional rites in mosques, even if the number that defeats the obligation of sufficiency. And that those in charge of the care of the mosques may organize the gathering and the groups in them in terms of beneficial measures, and this achieves the supposed worldly interest in reducing the possibility of infection, and the decisive religious interest in preserving the devotional rites in the mosques, and it pays the two harms that result from their miss.
