Abstract

The article examines the problematic issues encountered during the public inspection of residential premises, considers the question of the limits of the restriction of constitutional rights of citizens dur-ing the conduct of the specified operational search event. The author substantiates the need to nar-row the limits of the use of coercion in the course of conducting a public survey of residential premises, analyzes the feasibility of restricting a number of citizens' rights provided for by the Constitution of the Russian Federation, including property rights. In the article, the author offers a number of recommendations on amendments to the departmental regulatory legal act regulating the conduct of a public survey, in particular, the preparation of the final document and the legal settlement of issues related to the shelf life of items and documents seized during the implementation of the operational search activity under consideration.
