Abstract

The global community clearly states that corruption threatens law and order, democracy and human rights, destroys good governance, honesty and social justice, impedes competition and economic development, threatens the stability of democratic institutions and the moral foundations of society. The bodies of the court, the prosecutor's office in cooperation with other law-enforcement agencies of the state adopted a number of organizational and practical measures aimed at preventing and combating corruption. In particular, the State Program on the Prevention and Counteraction of Corruption for 2014-2017 continues to be continued. In order to ensure the proper organization of the activity of law-enforcement bodies in the field of prevention of corruption, a number of changes were made to the national anti-corruption legislation, namely, the Law of Ukraine “On Prosecutor's Office” introduced changes to ensure transparency in the organization of the activities of the Specialized Anti-Corruption Prosecutor's Office, which provides for the creation of a fundamentally new body of the prosecutor's office - Specialized Anti-Corruption Prosecutor's Office (hereinafter - SAP), the purpose of which is the implementation of the functions of the Prosecutor's Office in the field of prevention and as well as from October 14, 2014, No. 1698 - 18 “On the National Anti-Corruption Bureau of Ukraine”, a state law enforcement agency (hereinafter referred to as the NABU) was created. on which the prevention, detection, termination, investigation and disclosure of corruption offenses attributed to its jurisdiction, as well as the prevention of the commission of new ones, is entrusted. At present, people's deputies are trying at their best to develop and adopt a new law on the Anticorruption Court in Ukraine, as the High Specialized Court of First Instance, which will be prosecuted for criminal corruption proceedings that are being investigated by the National Anti-Corruption Bureau of Ukraine. In the activities of the prosecutor's office and the court, a special place is supervised and supervised for observance of laws during the pre-trial investigation carried out by law enforcement agencies. During the exercise of authority, there are certain contradictions between the organs of the General Prosecutor's Office of Ukraine, the Specialized Anti-Corruption Prosecutor's Office and the National Anti-Corruption Bureau of Ukraine arising from the gaps in legislation and its application. Therefore, it is proposed to clearly delineate the functions of each law enforcement agency in accordance with the norms of the Constitution of Ukraine, the Laws of Ukraine “On the Prosecutor's Office”, “On the National Anti-Corruption Bureau of Ukraine”, “On the Judicial System and Status of Judges”, “On Prevention of Corruption” and the Criminal Procedural Code of Ukraine.
