Abstract

Reconstruction and redevelopment projects should follow the procedures of decision by majority from the urban improvement act to determine major particulars. Conflicts accompanied by the procedures are the main reasons to delay the schedule of the projects and decrease profitability. This study identified why lawsuits in relation to decisions by majority are frequently filed on the basis of the analysis of the urban improvement act and analyzed relevant cases in order to arrange data about lawsuits for reconstruction and redevelopment projects. Dependent variables are reasons of lawsuits in relation to decisions by majority, while independent ones are economic indices of business places and steps. As the result of the analysis of basic statistics, lawsuits included the places with a large amount of area, a number of union members or construction households and a large amount of area per capita. As the result of the logistic regression analysis of reasons for lawsuits in relation to decisions by majority, they increased when the area per capita was bigger or the number of union members was larger. They were also raised up by high benchmark interest rates, low housing prices or many housing transactions when a promoting committee was established. The economic indices had little influence on filing lawsuits in the case of designated redevelopment areas or established unions. It is important for this study to use jurimetrics according to legal interpretation and empirical analysis.
