Abstract

This study was conceived in the background of increasingly higher percentage of the elderly in the entire population and full-blown implementation of various government policies to control the situation. The government has made extensive efforts to secure a comfortable life for the elderly including a range of government-led policies, but there are several issues in a legislative aspect. Those issues can go against the social atmosphere of guaranteeing the elderly the human rights and further promoting their rights. In the content of elderly laws, first, the problems stem from the fact that practical benefits cannot reach more senior citizens. Then it is also problematic that the realistic volume of assistance is in considerable shortage as practical help for the beneficiaries of benefits. Recognizing those problems, the present study set out to propose a variety of improvement measures to secure and further enhance the human rights of the elderly. including the protection of unlisted rights in clause 1 of Article 37 of the Constitution expressing the obligation to protect basic human.
