Abstract
In the article the theoretical analysis of the provisions of the Russian Federation Criminal Procedure Code, regulating the procedural activities of the defense and the legal representative of a juvenile suspect (accused). The author identified gaps in the current legislation and ways to fill them. Summarizing the materials of judicial practice, the author presents data on the effectiveness of participation of defense counsel and legal representative.

На основании изложенного необходимо: — дополнить пункт 12 статьи 5 УПК РФ после слова «родители» словами «а в исключительных случаях и иные близкие родственники»; — дополнить статью 48 УПК РФ частью второй следующего содержания: «В качестве законных представителей допускаются близкие родственники несовершеннолетнего, если они проживают совместно с ним и могут осуществлять контроль за его поведением»; — дополнить статью 426 УПК РФ частью пятой следующего содержания: «От участия в уголовном деле может быть отстранен законный представитель, не оказывающий влияния на несовершеннолетнего и не осуществляющий контроля за его поведением, либо признанный в установленном порядке больным алкоголизмом или наркоманией, либо ведущий асоциальный образ жизни
В заключение уместным выглядит изложение части 1 статьи 426 УПК РФ в следующей редакции: «Законный представитель несовершеннолетнего подозреваемого, обвиняемого допускается к участию в уголовном деле на основании постановления дознавателя, следователя одновременно с защитником
