Abstract

The article considers the definition of «family members» from the point of view of the circle of persons included in it, as well as problems arising from the lack of a specific legislative consolidation of this concept. The methodology of the article are: the method of legal analysis, which examines the criteria applicable to the persons subject to the inclusion of family members, the comparative method, which compares the concept of «family members» in the family and housing legislation, a comparison of the number of persons included in the family members with the circle of persons who are close relatives, as well as a comparison of the definition of «family» in the legislation of the countries of the former Soviet Union. In addition, the method of theoretical generalization is used, as a result of which the very formation and development of the family as a social and legal institution is considered directly.
