Девиации как гипотетическая основа негласно-конспиративного сегмента оперативно-розыскной деятельности (на примере легендированных объектов)

Abstract

The article is devoted to the analysis of the modern crime detection means and methods. The author considers that contemporary operative-investigation activity is based on diverse functional and legal tools; some of them are similar to the oldest socio-psychological deviations of society, but aimed at achieving the social and humanistic goals of society. 
 The Russian legislation declares the right of the subjects of the operative-investigation activity to «create enterprises, institutions, organisations and divisions necessary to solve tasks», but does not reveal the essence of these terms, called in the professional environment «legendary objects».
 On the basis of a comparative and meaningful analysis of some excerpts from the classic work «The Golden Calf» with the provisions of modern Russian operative-investigation legislation, scientific views on the issues of the operative-investigative activity and the recent detective practice, the author highlights the main features of such a means of «legendary object” and talks about its genesis, purpose, current condition and prospects for use in solving the problems of crime prevention and detection.
 The author concludes on possible directions for using legendary / undercover objects in revealing a wide range potential criminals and documenting their criminal activities, as well as in detecting and solving crimes.
