Abstract

الإعجاز التشريعي في الميراث خالد فؤاد محمد بليل قسم الدراسات الإسلامية، کلية الآداب، جامعة سوهاج، سوهاج، مصر. البريد الإلکتروني: dr_khalid1985@yahoo.com ملخص: الإعجاز التشريعي يعتبر من أهم وجوه الإعجاز، وما زال الإعجاز التشريعي عموما مجالا خصبا للبحث والتنقيب فيه، ففي تشريع الميراث أوجه إعجازية عديدة من أبرزها الإعجاز الاقتصادي والبياني. وتستمد هذه الدراسة أهميتها في الوقوف على الأسرار البالغة والحکم الجليلة من تشريع الميراث، وبيان وجوه الإعجاز التشريعي في الميراث. وتهدف الدراسة إلى إبراز أوجه التشريع في الميراث من خلال آيات الأحکام في القرآن الکريم، مع ذکر حکمة التشريع وجماله ووفائه بحاجات البشر وملاءمته للفطرة السليمة، وإطلاقه للطاقات الإيجابية في الإنسان، وبيان ما اشتملت عليه التشريعات في باب الميراث، من حکمة وعدالة في التوزيع، وما حوتها تلک الآيات من إعجاز بياني. والتزم البحث المنهج الاستقرائي الاستنباطي، وذلک باستقراء ما کتب حول موضوع الإعجاز التشريعي والميراث قديما وحديثا، ثم من خلال تلک القراءات والتدقيق في کتاب الله عز وجل لآيات المواريث والسنة النبوية المطهرة ما يختص بذلک الموضوع، واستنباط الأوجه الإعجازية لتشريع الميراث، مع اتباع المنهج العلمي في کتابة الأبحاث. وکان من أهم نتائج الدراسة: الإعجاز التشريعي من أهم وجوه الإعجاز في القرآن الکريم، وذلک لوجوده في کل التشريعات الإسلامية الکلمات المفتاحية: الإعجاز التشريعي، الميراث، علم الفرائض، الإعجاز الاقتصادي، الإعجاز البياني. Legislative Miracle in Inheritance Khaled Fouad Mohamed Bellil Department of Islamic Studies، Faculty of Arts، Sohag University، Sohag ،Egypt Email: khalid1985@yahoo.com Abstract: The legislative miracle is considered one of the most important aspects of the miracle، and the legislative miracle in general is still a fertile field for research and exploration. This study derives its importance in identifying the great secrets and the great judgment from the legislation of inheritance، and to explain the aspects of the legislative miracles in the inheritance. The study aims to highlight aspects of legislation in inheritance through the verses of rulings in the Noble Qur’an، with mentioning the wisdom of legislation، its beauty، its fulfillment with the needs of human beings and its suitability for common sense، and its release of positive energies in man، and stating what the legislation includes in the chapter of inheritance، in terms of wisdom and fairness in distribution، etc. I contained those verses from the miracle of my statement. The research adhered to the deductive method، by extrapolating what was written on the subject of legislative miracles and inheritance، in the past and in the present، then through those readings and scrutinizing the book of God Almighty for the verses of inheritance and the Sunnah of the Prophet that is purified with regard to that topic، and devising miraculous aspects of the legislation of inheritance، while following the scientific method in Writing research.
