Abstract

The article notes the importance of considering the level of cognitive abilities of persons involved as participants in criminal proceedings. In cases where a participant in criminal proceedings is unable to realize his/her rights and legitimate interests due to difficulties in understanding the nature of his/her actions and in directing them, public authorities carrying out criminal prosecution and justice should apply procedural means of a compensatory nature based on the characteristics of the limited capabilities of this participant.
