Abstract

This article analyzes the problems arising in practice when first-instance sentences are passed and amnesty law is to be enforced or when the statute of limitations in criminal cases applies. Some theoretical conclusions have been drawn as to the nature of the sentence given in the application of these two institutes аnd also the question what its contents in these cases should be is answered.
