О необходимости разработки комплексной методики оперативно-разыскного обеспечения уголовного судопроизводства по делам о незаконном сбыте наркотических средств

Abstract

As a part of the analysis of the practice of counteraction of the illicit sale of narcotic drugs, the article highlights a number of circumstances that testify to the need to develop the integrated methodology of the operational-investigative provision of criminal proceedings in cases of illicit drug sales that would include recommendations not only to identify and document these crimes but also on the operational support of their investigation and the trial in criminal cases. The content of each circumstance is disclosed: the description of the criminal activity related to the illicit sale of narcotic drugs; the unity of goals and objectives of operational-investigative and criminal procedure activities; the low level of interaction between operational units and bodies of preliminary investigation; the criminal proceedings participants need in knowledge about the features of obtaining of information of evidentiary value in the process of operational-investigative activity; the difficulties related to the examining in court the evidence obtained in the course of operational-investigative activity, to the protection of witnesses and other participants of criminal proceedings; active counteraction on the part of stakeholders at the pre-trial.

Рассмотренные обстоятельства свидетельствуют о наличии объективных предпосылок для разработки комплексной методики оперативно-разыскного обеспечения уголовного судопроизводства по делам о незаконном обороте наркотических средств, которая бы включала научно обоснованные рекомендации для всех этапов противодействия указанным преступлениям — их выявления, документирования, расследования и судебного разбирательства уголовных дел

Они должны обладать достаточными знаниями о процессах, происходящих в криминальной наркосреде, участниках незаконного оборота наркотиков, механизме образования оперативно-разыскной* информации, об особенностях проведения оперативно-разыскных мероприятий и использовании их результатов в доказывании по уголовным делам в процессе их расследования, а также о мерах по оперативно-разыскному сопровождению судебного разбирательства дел о незаконном сбыте наркотических средств.
