Abstract
Current legislation in the field of admission of litigation participants to state secret is discussed in the article. The legal positions of the Constitutional Court of the Russian Federation related to the interpretation of the Law of the Russian Federation «On State Secret», as well as the observance of the right of persons participating in the case to qualified legal assistance in court proceedings are also analyzed. The gaps in the legislation that lead to the emergence of administrative barriers that prevent the persons participating in the case from getting acquainted with materials containing state secrets are identified in the article. Specific recommendations for amending the current legislation in the field of protecting state secret in order to fulfill constitutional human rights as to qualified legal assistance and a fair trial are proposed by the authors.
