Abstract

Using specific cases of the replacement of a fine imposed by a sentence with another punishment in the case of malicious evasion of the convicted person from paying it, the author analyzes the legal consequences of the partial payment of the fine. It is shown that the court takes in to account the partial payment of the fine by the convicted person, its size in relation to the total amount of the fine determined by the sentence, the time when the funds were paid in to the deposit account of the court. As a general rule, they are taken in to account by the court when declaring (non-declaring) malicious evasion of the convicted from paying the fine.
