Abstract

The subject of the research within the framework of this article is the public relations developing regarding the realization of the right to receive information about the state of protection of the population and the environment from the effects of dangerous biological factors through the formation of a unified state information system in the field of biological safety in the Russian Federation. The legal nature of one of the biological rights is revealed – the right to receive information about the state of protection of the population and the environment from the effects of dangerous biological factors, the general characteristics of the subsystems of the state information system in the field of biological safety and their legal regulation are given, the peculiarities of the implementation of this right through automated subsystems are revealed. It is indicated that the formation of a unified state information system is a necessary way to ensure the implementation of the biological right to information. In order to study the process of realization of the right through the state information system, the author analyzed information systems that have already been created or are under development related to the realization of the biological right to information, and also for the purpose of using by analogy, information systems ensuring the realization of the constitutional right to reliable information about the state of the environment were analyzed. The article analyzes judicial and law enforcement practice on the development and application of information systems, on the basis of which the author came to the conclusion that the unified state information system in the field of biological safety, which received legislative regulation in Federal Law No. 492-FZ of December 30, 2020 «On Biological Safety in the Russian Federation», is currently It has not been systematically developed and put into operation. In this regard, the author has designed an approximate architecture of the future unified state information system in the field of biological safety, taking into account existing developments and experience in using information systems that ensure the implementation of the constitutional right to reliable information about the state of the environment.
