Jurisdiction on the Implementation of the Decision of the National Sharia Arbitration Board

Sharia economy is an economic business or activity carried out by individuals, groups of people, and business entities in order to meet commercial needs according to sharia principles. In the last three decades, Sharia economy has increased the potential for disputes. The disputing parties tend to choose a non-litigation path through Alternative Dispute Resolution (APS), one of which is with the National Sharia Arbitration Board. This judicial institution has the authority to resolve sharia economic disputes. The results of this study show that the authority of the National Sharia Arbitration Board in resolving sharia economic disputes is determined by the existence of an Arbitration Agreement, either made before the dispute arises (Pactum Compromittendo) or made after the dispute occurs (Acta Compromis). Thus, the legitimacy of the authority of the National Sharia Arbitration Board in resolving sharia economic disputes is based on the Pacta Sunt Servanda principle and the Consensual Principle regulated in the Civil Code. Furthermore, the registration and execution of the Decision of the National Sharia Arbitration Board should be carried out by the Religious Court, including in legal efforts to cancel the Decision. This is based on two factors, namely the legal basis of the absolute competence of the Religious Court in resolving sharia economic disputes as regulated in Article 49 of Law Number 3 of 2006 concerning Religious Courts and the basis of the relevance of the substance of Islamic law used by the National Sharia Arbitration Board.

Implementation of Islamic Microfinance through Marketing Strategy for Financing Rural Communities in Cirebon Region

Microfinance provides access to financial services for low-income people, empowering and increasing business productivity in achieving prosperity. Rural communities are the group most interested in microfinance because it is often neglected by the formal financial system. This research focuses on the characteristics of rural communities in improving the implementation of microfinance through financing marketing strategies. A descriptive qualitative approach is used in this study. The data sources are based on observations, in-depth interviews, and contextual literacy of various documents. The research respondents were female entrepreneurs who received sharia-based microfinance facilities from BTPN Syariah and PT Permodalan Nasional Madani in the Cirebon area. The data analysis techniques were carried out through Data collection, Data reduction, Data presentation, Conclusion drawing/verification. The implementation of sharia microfinance through financial institutions and financing institutions in the Cirebon area has proven to have a positive effect. The marketing strategy of Islamic microfinance institutions in rural communities helps the growth of sustainable micro enterprises. This is evidenced by the ease of access to financing and more flexible terms in applying for financing, being able to increase sales results, and a community approach to financing through rural women entrepreneurs that helps reduce unemployment and poverty rates. The economic impact in the application of the concept of sharia economics encourages the principles of justice and social welfare, in addition to being able to provide access to capital. The implementation of sharia microfinance in rural communities in Cirebon has positive and transformative implications for the economy and social of the community by increasing access to financing, encouraging the growth of micro businesses, empowering women, reducing poverty and dependence on loan sharks, although it is still faced with the challenges of limited capital, low Islamic financial literacy, and the need for adequate regulatory support

TRANSFORMATIONAL LEADERSHIP IN THE MANAGEMENT OF MODERN PESANTREN

Modern pesantren face significant challenges in managing Islamic educational institutions to remain relevant in the era of globalization without losing their identity. Transformational leadership is one approach that can be applied to ensure that pesantren can develop adaptively and innovatively. This study aims to analyze the role of transformational leadership in the management of modern pesantren, focusing on strategies for enhancing human resource capacity, strengthening financial independence, optimizing technology, and establishing strategic partnerships. The research method used is a literature study (library research) with a qualitative descriptive approach. Data sources were obtained from indexed journals, academic books, and relevant policy documents. The data were analyzed using content analysis techniques with a thematic approach to identify key patterns in the implementation of transformational leadership in modern pesantren. The results indicate that transformational leadership plays a crucial role in driving positive changes in modern pesantren. Through systematic strategies, pesantren can enhance human resource capacity through leadership training and certification, strengthen financial independence by managing business units based on sharia economics and productive waqf, and optimize technology in pesantren management systems. Additionally, partnerships with universities and industries create opportunities for pesantren to continue innovating and improving their competitiveness at both national and international levels. This study contributes academically to the discourse on pesantren leadership and serves as a foundation for further empirical research. It is expected that the findings of this study can serve as a reference for pesantren administrators in implementing more effective and sustainable transformational leadership.

Pemikiran Hukum Islam Perspektif Yusuf Al-Qardawi

Yusuf al-Qardawi's Islamic legal thought is a form of contemporary ijtihad that emphasizes the elasticity of Islamic law and the principle of religious moderation (wasathiyyah). The background of this study is based on the need for Muslims to understand Islamic law in a more flexible context and relevant to changing times. Al-Qardawi proposed a legal approach that is not only based on texts alone, but also considers social, economic, and cultural aspects. The purpose of this study is to analyze the concept of elasticity of Islamic law according to Yusuf al-Qardawi and how this principle is implemented in various aspects of life, such as Islamic economics, family law, politics, and criminal law. In addition, this study also examines the role of moderation in religion as a solution to extremism and radicalism that often arise due to an understanding of Islam that is too rigid or liberal. Previous studies have shown that many studies have discussed al-Qardawi's thoughts from the aspects of Islamic law, sharia economics, and Islamic politics. However, this study focuses more on the integration between the elasticity of Islamic law and the concept of moderation that characterizes al-Qardawi's thoughts. This study fills the research gap by offering a comprehensive analysis of the relevance and application of these concepts in a contemporary context. The research method used in this study is a qualitative method with a descriptive-analytical approach. Data were collected through a literature study of Yusuf al-Qardawi's works, scientific articles, and other relevant secondary references. The analysis was conducted by examining how the concepts of Islamic legal elasticity and religious moderation are applied in various aspects of life. The results of the study show that Yusuf al-Qardawi's Islamic legal thinking has made a major contribution in presenting Islamic law that is more adaptive and relevant to the conditions of modern society. The concept of Islamic legal elasticity that he developed opens up a wide space for ijtihad so that Islamic law remains contextual and provides solutions to the problems of the people. The religious moderation that he promotes is also an important foundation in building a more inclusive and tolerant understanding of Islam.

Integration of Musharakah Financing in The Development of MSMES in Developing Countries: Sharia and Sustainable Finance Perspectives

MSMEs (Micro, Small, and Medium Enterprises) play an essential role in the economies of developing countries. However, they often face difficulties in accessing financing that aligns with sustainable finance and Sharia principles. Musharakah financing, based on the principle of profit sharing, is an alternative that can support the development of MSMEs, particularly in developing countries that prioritize the Sharia economy. This research aims to analyze the integration of musharakah financing in the development of MSMEs in developing countries, as well as evaluate the benefits and challenges related to the application of sharia principles and sustainable finance in this context. This research employs a qualitative approach, utilizing case studies in several developing countries, including Indonesia and Malaysia. Data were collected through interviews with MSME actors, Islamic financial institutions, and relevant government agencies. The analysis was carried out by comparing musharakah financing practices in the MSME sector and their impact on business sustainability. The results of the research indicate that musharakah financing can enhance MSMEs' access to capital in a more equitable and sustainable manner. However, the main challenges include a lack of understanding of Sharia concepts and regulatory barriers that hinder optimal development. Musharakah financing has demonstrated the potential to stimulate local and global economic growth when supported by the right policies.

Strategies and Challenges of Development Economy in Realizing Sharia-Based Sustainable Growth

Islamic economics plays a crucial role in addressing the economic challenges of sustainable development in Indonesia. With principles based on social justice, wise management of natural resources, and redistribution of wealth, usury is prohibited. This research aims to examine the role of Islamic economics principles and identify appropriate strategies to overcome the economic challenges of sustainable development in Indonesia. This research employs a qualitative approach, utilizing a systematic review method to analyze the latest scientific articles from the past decade, as well as e-books. The results showed that the principles of the five central values of Islamic economics, such as tawhid, justice, prophethood, khilafah, and ma'ad, can contribute to sustainable economic development. Islamic economic strategy in Indonesia plays a crucial role in promoting sustainable economic growth by increasing public awareness of Islamic economic literacy, strengthening the Islamic financial sector, developing the halal industry, leveraging digital technology, and fostering collaboration between the government and society to achieve inclusive welfare. This study concludes that by applying the principles of sharia economics, Indonesia can create a fairer financial system, reduce social inequality, and ensure long-term economic stability. The goal of this research is to create a fair, inclusive, and sustainable economic system that enhances people's welfare and preserves the environment by applying Sharia principles in all aspects of economic development.

Human Resource Management (HR) to Customers in Bank Syariah Mandiri

Islamic banks in Indonesia have experienced good development in terms of assets, number of offices, number of customers, and the market share of Islamic banks has exceeded 5 percent. The development of Islamic banking is not accompanied by a sufficiently good human resource base in terms of quantity and quality. The source of human energy is still a difficult problem for Islamic banks. In the 2015-2019 Islamic banking roadmap issued as a financial service sovereign, the problem of people's resources becomes a matter that must be resolved. A pattern of human resources management is needed that can produce quality human resources for Islamic banks. This note is descriptive qualitative in nature which seeks to describe the development of quality human resources for Islamic banks. This note proves that there was a development of human resources in Islamic banks in the period 2015 September to September 2019 experiencing large and efficient developments, with the current overall HR of Islamic banks. The pattern of management of Islamic sources of energy is important for the availability of good quality Islamic banking human resources compatible with experts in the field of Islamic banking. Management of Islamic human resource base is able to fulfill human resources who understand economics and sharia economics. Islamic resource management that is relevant to the current situation of Islamic bank HR is Celestial Management. Which consists of ZIKR, PIKR, and MIKR.

Analisis Implementasi Akad Ju’alah dalam Program Affiliasi Digital Studi Kompratif Shopee Affiliate dan Tiktok Affiliate

This study was conducted with the aim of analyzing the implementation of the ju'alah contract in digital affiliate programs, namely Shopee Affiliate and Tiktok Affiliate, and comparing the mechanisms of both in the context of sharia economic law. The ju'alah contract is a form of muamalah contract based on services, where someone offers compensation (ju'l) to another party for certain work that has been agreed upon in advance. This study examines both affiliate programs in terms of fairness, transparency, and sustainability, which are the main principles in sharia economics. This study uses a qualitative research method with descriptive analysis with a library research approach to identify how the ju'alah contract is applied in digital affiliate marketing practices, the challenges faced, and opportunities that can be utilized to increase the effectiveness of its implementation. The results of the study show that although there are similarities in the basic principles of the ju'alah contract between Shopee Affiliate and Tiktok Affiliate, there are differences in the implementation and payment mechanisms that need to be considered regarding sharia principles, such as clarity of rewards, transparency, and fairness. This study can provide recommendations for improvements in terms of payment transparency according to sharia principles on both platforms to ensure compliance with deeper sharia economic values.

The Role of Sharia Economic Stakeholders in Indonesia’s Sharia Economy Masterplan 2019-2024: Pentahelix Concept Analysis

Indonesia's Sharia economy has grown rapidly in recent years, attracting the attention of investors both domestically and internationally. In 2019, the Indonesian government launched the Sharia Economic Masterplan 2019-2024 to strengthen the Islamic economic ecosystem and position Indonesia as the world's leading Islamic economic center. This study aims to analyze the role of each Islamic economic stakeholder in the 2019-2024 Indonesian Islamic Economics Masterplan using the Pentahelix concept analysis. The results show that the government plays a crucial role as a regulator in formulating policies and regulations that support Islamic economic development. Through research and public consultation, academics contribute relevant concepts and innovations to the development of the Islamic economy. Islamic business people and financial institutions, such as Islamic banking, Islamic capital markets, and MSMEs, play an essential role as drivers of the halal industry. The Islamic economic community acts as an accelerator in strengthening the halal industry in various sectors. Meanwhile, as a multiplier, the media plays an essential role in maximising the fulfillment of the halal market share by promoting and educating the public about the available halal products and services. It is hoped that the synergy between stakeholders can achieve inclusive, sustainable sharia economic growth and encourage the progress of the halal industry in Indonesia.

Farmers' Coping Strategy in Maintaining Household Economic Stability in the Dry Season: A Sharia Economic Perspective

This study analyzes the coping strategies employed by farmers in Rombiya Barat Village, Ganding, to maintain household economic stability during the dry season from an Islamic economic perspective. Employing a qualitative approach, this research utilizes in-depth interviews with selected farmers through purposive sampling. The data were analyzed using a thematic approach to identify key survival strategies. The findings reveal three primary coping strategies: active strategies, passive strategies, and networking strategies. From an Islamic economic perspective, business diversification that adheres to the principles of halal and thayyib plays a crucial role in sustaining farmers’ economic resilience. Furthermore, the study highlights that food security among farmers is significantly influenced by socioeconomic conditions, natural resource management, and the practical implementation of Islamic economic principles. This research contributes to the understanding of Islamic economic-based rural resilience and offers policy insights for enhancing sustainable agricultural development.

Edukasi Dhuafa Mart Dalam Pengembangan Ekonomi Syariah Lokal Di Air Tiris

This community service activity aims to improve public understanding of sharia economics through education conducted at Dhuafa Mart, Air Tiris. Dhuafa Mart is a sharia-based economic business that not only functions as a trading center, but also as a means of empowering the poor community. Through this education program, the community is given an understanding of the concept of halal transactions, Islamic financial management, and sharia-based business strategies that can be applied in micro and small businesses. The methods used in this activity are stages of socialization, training, and mentoring for managers and local business actors. Data and evaluation of the success of the program are carried out through observation, interviews, and questionnaires to education participants. The results of the activity show that the education provided has a positive impact on increasing public understanding of the principles of sharia economics and its application in daily businesses. In addition, this program also encourages active community participation in developing sustainable sharia-based businesses. As a recommendation, there needs to be strengthening of synergy between Dhuafa Mart and sharia financial institutions and local governments to provide further support in developing sharia-based businesses.

Transaksi Akad Musaqah Di Tinjau Dari Hukum Ekonomi Syari’ah

This research aims to explain how the implementation of the musaqah contract is reviewed in sharia economic law for rubber plantation cultivators in Pematang Duku village, Bengkalis sub-district, Bengkalis district. This research uses interview and documentation data collection techniques. Interviews were conducted with people who collaborate, namely between garden owners and gardeners. All data was analyzed inductively. From the research results, it turns out that the contract was carried out orally without any witnesses or written evidence and the time limit for the contract was not specified. Regarding the fulfillment of rights and obligations carried out by both parties, it is not in accordance with the agreement (contract) because the cultivator does not or does not fulfill the obligation to care for the rubber plantation where this obligation has been imposed on the rubber cultivator and was agreed upon at the time of the contract, this is very detrimental the garden owner. As for the implementation of profit sharing in the practice of musaqah contracts in Pematang Duku Village, viewed from Sharia Economic Law, in accordance with the initial agreement. However, from the profit sharing there is a profit that does not match what the garden owner expects because the cultivator's obligation to care for the garden has not been fulfilled

Sosialisasi Dan Edukasi Ekonomi Syariah Untuk Pelajar: Fondasi Kuat Menuju Kesejahteraan Dan Keadilan Berbasis Syariah Di Sma It Al-Utsaimin Bangkinang

This community service activity was carried out for students of SMA IT Al-Utsaimin Bangkinang, Riau Province, where the purpose of this community service is to provide provisions in increasing understanding of the concept of Sharia Economics to the community, especially generation Z of students of SMA IT Al-Utsaimin Bangkinang. The methods used in this community service activity are through counseling and presentation, discussion and practice (pretset and post test) for participants. The counseling method is used to explain the importance of knowing the concept of Sharia economics for students in order to become prosperous generations using sharia principles. The presentation method is used to show a work process, namely the stages of how we can become individuals who have a prosperous economy. While the question and answer method is used to give participants the opportunity to consult in understanding further the material that has been given. The practice method is used to see how far the participants understand the service before and after the material is delivered. The availability of adequate experts in delivering this material, the enthusiasm of the participants, and the support of the principal for the implementation of the activity are supporters of the implementation of this PPM activity. The obstacles faced are that the students do not yet have initial knowledge about the material of the concept of Islamic economics and limited time in delivering the material. The results of this service indicate that: The community service program can be organized well and run smoothly according to the activity plan that has been prepared, the results of this service concluded that: First, Most students of SMA IT Al-Utsaimin do not understand the concept of Islamic economics well, Second, The achievement of the objectives of the community service program for students of SMA IT Al-Utsaimin Bangkinang, the entire program that has been carried out with collaboration between the school and the community service have been carried out all and in accordance with the event rounddown and the time that has been determined previously.

Free Nutritional Meals Program (Mbg) in Indonesia: Human Development according to an Islamic Perspective (Sharia Economic Review on Aspects of Insaniyah Development)

This study aims to analyze the Free Nutritious Meals (MBG) program from the scope of human capital development from an Islamic economic perspective. MBG, which was born from President Prabowo Subianto's government program, does not contradict Islamic teachings in the slightest. This is not only from an Islamic economic perspective but also from the spirit of implementing Pancasila values and the mandate of the 1945 Constitution. Moreover, world religions other than Islam also provide support for the MBG program according to their teachings, as do humanitarian institutions in the world. The research method used in this study is qualitative research with library research. With the accuracy of this methodology, its main focus is exploring the literature to provide strong reasons for theoretical and empirical facts. The results of this study confirm that the MBG program is under the principles of Islamic economics in Indonesia as outlined by the maqashid al-syariah taught by the Qur'an and strengthens the human capital development system (insaniah), especially Muslims who are in number the recipients of the tremendous benefits from the implementation of the program.Keywords: MBG; Indonesia; Human Capital; Islamic Economics; Maqashid al-Shariah

Islamic Financial Literacy and Concept of Islamic Economics Development in School

This research aims to analyse the level of economic literacy and Islamic finance as well as formulate concepts for sharia economics curriculum development. The research method uses a quantitative approach. A quantitative approach through questionnaires to measure the level of sharia financial literacy and obtain an overview of curriculum development models in schools. This research measures the Sharia Financial Literacy Level of High School Students and Teachers in Kudus Regency with sample data of 17 teachers and 152 students from five state high schools in Kudus Regency. From the analysis results, the financial literacy level of students and teachers falls into the sufficiently literate category. However, in terms of sharia insurance literacy, it is in the less literate category. Meanwhile, curriculum development provides an overview of development models with several approaches. The first approach is through socialisation and education; the second approach is by including Islamic economics subjects into the curriculum content structure, especially the Social Sciences department; the third approach is the application of contextual learning, namely students learn in theory and also in real practice in Islamic financial institutions; and the fourth approach is teaching Islamic accounting at school.

Implementasi Fikih Muamalah dalam Ekonomi Kreatif Membangun Mahasiswa Muslim Entrepreneur

Muamalah jurisprudence is an important part of sharia economics which regulates various aspects of business transactions so that they are in accordance with Islamic principles. The implementation of muamalah fiqh in creative entrepreneurship among students is very relevant, considering the importance of building an entrepreneurial character that is not only economically profitable, but also in accordance with sharia. This research aims to analyze the application of muamalah fiqh in creative entrepreneurial activities among STIT Rakeyan Santang students and identify the obstacles faced in its implementation. The research method used is descriptive quantitative with a survey approach. Data was collected through questionnaires distributed to students involved in entrepreneurship, as well as interviews to explore opinions in more depth. The research results show that although the majority of students have a basic understanding of the principles of muamalah fiqh, they experience difficulties in applying them in creative business. Around 70% of students stated the need for practical training related to the application of muamalah fiqh in their business. The implication of this research is the importance of developing a curriculum that is more practice-based and applying muamalah fiqh in the business world, as well as providing relevant training to improve students' entrepreneurial skills in accordance with sharia principles.

Amdal Analysis on C Excavation Management in the Ngoro Area, Jombang Regency in the Perspective of the Feasibility Study of Islamic Business in Sharia Economics

This article aims to understand the management of C excavations on the environment in the Ngoro Jombang area and its implications according to Regional Regulation Number 8 of 2017 concerning environmental protection and management and biah fiqh. This research is included in qualitative research. To obtain data, researchers obtain it directly from the source without intermediaries from other parties, which is then processed. There are two data sources, namely primary and secondary data sources. Data collection by means of interviews, observation, documentation. After the data is collected, it is analyzed using descriptive methods. The results obtained from data analysis are that the management of excavation c is mining which includes: sand, gravel, the process of which is by dredging the soil until it has holes to make a profit. In this activity the impact is not only on local residents, but also on the earth and the surrounding nature. In law and Islamic jurisprudence, it is permissible on the condition that it is not allowed to be excessive and destroy the natural surroundings just to meet the needs and prosperity of the community

The Role Of Higher Education In Human Resource Development Shariah Economy In Indonesia

This research analyzes the role of universities in developing professional Sharia Economic SDI (Insani Resources) to compete in the world of work, which ultimately has an impact on the development of Islamic Economics in Indonesia. The title of this research is the Role of Higher Education in Sharia Economic Human Resource Development (Study in the Superior Accredited Sharia Economic Study Program by LAMEMBA). The aim is to analyze, identify and also develop strategic steps for the role of the Sharia Economic Study Program in developing Sharia Economic Human Resources in Indonesia. This research uses qualitative research. The qualitative research design in this study uses a field and literature study approach, because this method is considered to be able to explain and answer the problems that this research wants to know. The data sources that researchers obtained to solve problems in this research were from literature (library research) as secondary data and field data (field research) as primary data. Data analysis, namely organizing data, making memos, describing and concluding. The following are some of the main roles and contributions of the two institutions: a) Education and Training of Professional Staff; b) Development of Sharia-Based Curriculum and Modules; c) Research and Development of Sharia Economics; d) Collaboration with Industry and Stakeholders; e) Public Socialization and Education about Sharia Economics; and f) Sharia Entrepreneurship Development.
