Perbedaan Kepuasan Pernikahan Ditinjau dari Peran dalam Pernikahan pada Individu yang Menikah Muda

The phenomenon of divorce in couples who marry young is considered related to marital satisfaction. Marital satisfaction is both a husband and wife's subjective evaluation of marriage. One factor that affects marital satisfaction is the role in the marriage. This study used quantitative research methods with a comparative approach. This research aims to see differences in marital satisfaction in terms of roles in marriage in individuals who married young. Sampling using nonprobality sampling techniques with a total of 120 research respondents. Normality test using Kolmogorov-Smirnov and obtained significance value (p)=0.000 (p<0.05). The homogeneity test uses the Test of Homogeneity of Variances (Levene Test) and obtained a significance value p=0.062 (p>0.05). The hypothesis test was carried out using the Mann-Whitney technique and obtained a significance value (p)=0.046 (p<0.05). The results of the study showed that there were differences in marital satisfaction in terms of the role of marriage in individuals who married young.

أنّ التطورات الكبرى في مجال تكنولوجيا الاتصال لعبت دوراً فعالاً في تغيير كثير من المفاهيم والأدوار والعلاقات الاجتماعية، وربط العالم في مجتمع واحدة من اجل التقارب والتعارف وتبادل الآراء والرغبات والمعلومات، لذا فقد أصبحت وسائل التواصل الاجتماعي وسائل لتحقيق رغبات الأفراد عبر مواقعها الافتراضية ، فضلاً عن تأثيراتها الايجابية الا ان هناك تأثيرات صحية واجتماعية ونفسية على الأفراد من جهة ،وخاصة على الأسرة العراقية من جهة اخرى، وعلى بعض افرادها المدمنين على استخدام وسائل التواصل الاجتماعي بشكل مفرط ، إذ أنّ الادمان على هذه الوسائل تعمل على عزل الفرد وإصابة بأمراض نفسية مؤثر وفاعله على صحته العقلية والجسمية لاسيما الزوجين ، كما تساهم هذه المواقع الافتراضية في ضعف الرقابة الأسرية على الأبناء ، مما يؤدي الى التفكك والتصدع الأسري وغيرها من الآثار ، لذا فقد اشارت الكثير من الدراسات الاجتماعية والنفسية أنّ الادمان الالكتروني الكثير لوسائل التواصل الاجتماعي تفقد حرية الفرد وتعزله عن واقعه الأسري ، إضافة إلى فقدانه المسؤولية العاطفية والجنسية لشريك حياته ، وهذا مما قد يسب حدوث خلافات وصراعات أسرية أي صراع بين الزوج والزوجة وفي نهاية المطاف يحدث الطلاق فيما بينهم. في بحثنا هذا نسعى التعرف على اثر وسائل التواصل الاجتماعي السلبي على الاسرة العراقية لاسيما الزوجين ، والتي تؤدي احيانا الى الانفصال والوصول الى مرحلة الطلاق .

Sakinah Mawadah and Rahmah in QS. al-Rūm [30]: 21: Analysis of Qirāah Mubādalah Faqihuddin Abdul Kodir (L.1971)

The phenomenon of divorce in Indonesia increases every year with various problems faced in a family. As time goes by, problems and solutions to overcome these problems also change, so that solutions that were commonly used in the past to deal with current household disputes are not appropriate. If referring to the interpretation of QS. al-Rūm [30]: 21 does not yet fully contain an interpretation regarding the current phenomenon of the concepts of sakinah mawadah and rahmah. This paper tries to respond to this problem by analyzing the interpretation of the QS. al-Rūm [30]: 21 uses the Qirā'ah Mubādalah perspective. The results of this research include; First, the interpretation of QS. al-Rūm [30]: 21 in the perspective of mubādalah is Allah SWT. shows one of the signs of His greatness by creating for his servants couples (both husband and wife) of the same kind so that they both feel calm and at ease, and tend to each partner. Then, to obtain this calm and tranquility, Allah SWT. bring a sense of love and affection between the two. These are the signs of His greatness for a people who think. Second, in its literal pronunciation, the verse discusses men who obtain peace from their wives, but in terms of its meaning, this verse also applies to women who obtain peace from their husbands. This is emphasized in the phrase bainakum which shows the reciprocal meaning between husband and wife.

The Phenomenon of Divorce during the Election Period in the Perspective of Islamic Law

This article delved into the perspectives of Islamic law about the divorce phenomena as it pertains to the election period. This phenomenon has been the subject of very little research about Islamic law. Legal anthropology brings an Islamic and conceptual studies perspective to this study technique. Consequently, this study aims to provide an Islamic perspective on these events and analyze them from a legal Islamic perspective. This article explained that ikhtilaf happened throughout the Islamic culture. During the election period, societal shifts inside the family led to the dissolution of the marriage. Since political opinions do not constitute nusyuz against the spouse, Muslims are free to have differing views on this matter. Only in religious issues is a woman bound to obey her husband. Thus, divorce is forbidden in Islam because of disparities in personal decisions. This study is expected to provide the groundwork for Islamic law and help families work through disagreements over political candidates during election period.

‘There is no compulsion in marriage’. Divorce and gendered change in Afghanistan during the Islamic Republic

ABSTRACT With the Taliban takeover in August 2021, many both outside and inside Afghanistan voiced concern that the conditions of Afghan women would return to those of the 1990s, when the group was last in power. Yet the question of whether the intervening decades of Western-installed rule produced any meaningful improvements in women’s status remains highly contested. This article explores the subject of gendered change during the Islamic Republic (2001–2021) through the growing phenomenon of divorce. We suggest that the notable increase in court divorces during this period did represent a destabilization of the near absolute marital authority that many Afghan men felt to be invested in them by society at large. At the same time, we show that the increasing resolve of women to take marital grievances to court must be located not just in normative shifts, but also in specific socio-economic transformations, which had chipped away at the material underpinnings of marriage as conventionally understood and organized. Overall we find that there were important changes in women’s ability to access certain rights during the Islamic Republic and that the return of Taliban rule therefore is a dramatic setback also for Afghan women’s rights in marriage.

The Role of Family Associations in Promoting Empowerment of Divorced Women for Sustainable Community Development: A Case Study from Ha’il

The current research determined the role of family development associations in reducing the phenomenon of divorce in Ha'il. The current research was an analytical descriptive social survey. Data was collected through a questionnaire applied to a sample of (98) participants who were frequent visitors to the family development associations in Ha'il. The research concluded that the role of family development associations was average in qualifying those about to get married, treating the problems of the newlyweds, and satisfying social, psychological, economic and legal needs of divorcees. Results, also, revealed that the role of family development associations in satisfying the social needs of divorced women ranked first compared to other roles

Changes of Effective Criteria in Marriage (1978 to 2021) from the Point of View of Couple Therapists: A Qualitative Study

Aim: The purpose of this research was to identify the indicators of changes in marriage from 1978 to 2022. Methods: To achieve the set goals, qualitative method (Strauss and Corbin's Grounded Theory) was used. Ten psychologist experts in marrage field with an average of 30.6 years of specialized activity in the field of couple relationship were selected using the purposeful sampling method and interviewed in depth until theoretical saturation. The data were recorded, coded and then classified in the form of concepts, sub-categories and main categories. Findings: The analysis of the professional experience of experts led to the identification of 138 secondary codes, 27 concepts, 8 sub-categories and 3 main categories. Changes in extra-spousal, inter-spousal and individual factors are the main categories of this research. Changes in factors such as roles, the phenomenon of divorce, the degree of influence of society, social teachings, the media, increasing the awareness of society, demographic characteristics, social experiences, policies, economic issues, modernization, cultural integration, attitudes, religious issues, the role of the family, the nature of relationship, relationships between the sexes, infidelity, commitment to responsibilities, drug/alcohol abuse, needs, choosing a spouse, motivation, knowledge of life, openness to new experience, and individual identity have been mentioned. Conclusion: This research showed that marriage during the years (1978-2022) was affected by changes in intra-individual, inter-spousal and extra-spousal factors. From the point of view of correcting the unfavorable situation of marriage at the time of research, stable and constructive economic, social and cultural policies seem necessary. Also, taking into account the current conditions of the society and the world, dealing with trainings that are appropriate to the changes that have occurred, paying attention to the individual identity and the needs of the new generation, can also help in arranging the marriage situation

Kawin Cerai di Era Post Modernisme; Studi Kasus Klien Ambu Consulting and Healing Center

The phenomenon of divorce at an early age of marriage continues to increase from year to year, so that it has become commonplace in this post-modern era. The phenomenon of high divorce is also faced by clients of Ambu Consulting and Healing Center. There are many factors behind the divorce phenomenon. This study aims to describe the level of cases of divorce in the post-modern era with the Ambu Consulting and Healing Center research locus, the factors that influence the client's decision to marry and divorce at the Ambu Consulting and Healing Center. This study uses a qualitative approach, collecting data through observation, interviews and documentation. Case study research was conducted on Ambu Consulting and Healing Center clients who were facing divorce problems. The results showed that the phenomenon of the client's divorce marriage at the Ambu Consulting and Healing Center showed that the human characteristics of the post-modern era were not able to take advantage of the positive side of the post-modern era. The factors that cause divorce are related to the lifestyle of the post-modern era.

TELAAH SOSIOLOGI HUKUM TERHADAP FENOMENA TALAK DI LUAR PENGADILAN AGAMA

The purpose of this study is to examine the phenomenon of divorce that occurs outside the Religious Courts, especially in Bangun Purba Village. Then describes the practice of divorce in the Bangun Purba community in terms of Sociology of Law. While this type of research is field, which uses a qualitative approach. While the primary data collection methods, namely observation, interviews and documentation. To examine more deeply, researchers use legal system theory which is categorized into three types, namely legal substance, legal structure and legal culture. The results of this study indicate that the occurrence of divorce outside the Religious Courts was caused by ordinary matters and was not questioned by positive law. In addition, according to three respondents, the method of divorce that was carried out was familial (custom), namely through intermediaries, and partly witnessed directly by their respective families.

Dimensions of the Malaysian Experience in Rehabilitating those Who are About to Get Married and the Implications

In this paper, we reviewed the dimensions of the Malaysian experience in preparing and rehabilitating those who are about to get married, which is called (the marriage license). The success achieved by that experience within the Malaysian society, in which the divorce rate - at one time - reached nearly 32%. After applying this experience in Malaysia, the divorce rate decreased to 7%. This confirms the importance of preparing and qualifying those who are about to get married of both sexes (male and female); achieves stability within the family, which is one of the building blocks of society. It included the Malaysian experience, which came after an extensive scientific study that includes many scientific programs that would achieve a happy family climate. These programs included a package of psychological rehabilitation programs, social preparation, religious preparation, in addition to economic preparation. This package of rehabilitation programs came in order to advance the Malaysian family and seek to eliminate and reduce the phenomenon of divorce within Malaysian society. In this study, we relied on the inductive approach as well as the analytical approach to reach a statement of the dimensions of this unique experience and the success achieved in the Malaysian society, and how to benefit from it globally, with the aim of achieving stability within the family in general. This is done through two chapters and a conclusion.

Divorce and its Negative Impact on the Educational Achievement of School Students

This article sheds light on the phenomenon of divorce and its negative impact on children's educational achievements. This article is intended to contribute to the enrichment of knowledge in the field of divorce, the field of education, and the field of education. The social and cultural context. The increase in the incidence of divorce increases the interest in dealing with this issue, which is a worrying phenomenon, since the divorce of the parents has consequences for the children's lives and in fact directly affects the educational achievements in general, and afterwards. We have academically weak children and this has a negative impact on society because the children are the backbone of any society and they are the people of society's future. Through this article, I reached important results from a social point of view, as children are victims of the phenomenon of divorce, and this affects them negatively from a social point of view, as it causes them to be isolated and not to engage in society. Educationally, divorce leads to a decline in the academic level of students, and psychologically, divorce negatively affects children's psyche and their self-perception. I recommend intensifying awareness and education centers for young people about to get married, which may lead to reducing the phenomenon of divorce, and increasing specialized centers in divorce affairs and trying to find compromises between couples who suffer from family problems.

Divorce of Intoxicated Persons in the Islamic Jurisprudence and Afghan Civil Law: An Inductive and Analytical Juridical Study

The phenomenon of divorce in the context of intoxication has drawn limited scholarly attention, necessitating an exploration of its legal implications and theoretical underpinnings. This study employs an inductive and analytical approach, structured into an introduction, three main sections, and a conclusion that encompasses the research findings. The study synthesizes primary legal sources from Islamic jurisprudence, including the Quran and Hadith, alongside relevant provisions of the Afghan Civil Code and pertinent case law. Through a comprehensive examination of Islamic principles and legal precedents, the research delves into the multifaceted issue of divorce within the context of intoxication, addressing pertinent questions regarding the legal capacity and consent of an intoxicated individual to initiate or accept divorce. The analysis also investigates the rights and protections afforded to both parties in such circumstances, considering the overarching objectives of Islamic family law. The study highlights the varying approaches between Islamic jurisprudence and Afghan civil law, identifying potential areas of harmonization or conflict. Drawing on case examples and hypothetical scenarios, the paper further contextualizes the theoretical findings and proposes possible legal reforms to address the complexities arising from the divorce of intoxicated individuals. Ultimately, this research contributes to a deeper understanding of Islamic family law and its application in Afghanistan, while shedding light on the challenges posed by intoxication in the divorce context. The findings of this study may inform legal practitioners, policymakers, and scholars seeking to promote justice, equity, and protection within the realm of family law in both Islamic and Afghan legal systems.

MENELISIK FENOMENA PERCERAIAN PADA AKTOR PERNIKAHAN DINI DALAM PERSPEKTIF STRUKTURAL FUNGSIONAL

Early marriage is generally carried out by young couples who are not mentally and physically ready to build a quality household. The purpose of this study is to examine and explain the phenomenon of divorce in early marriage cases based on functional structural theory. The method used in this research is a literature study, which is the process of selecting, reading, recording and collecting references that are relevant to the topic of study as a data source. The results of the study state that until now, divorce has become one of the crucial problems considering the negative impact caused after divorce is very complex, especially in cases of divorce that occur in actors who previously underwent young marriages. Functional structural theory views that divorce occurs because of an imbalance in the family. In addition, early marriage has a higher potential for divorce due to the lack of individual readiness, so that instability in the family occurs more often, in this case early marriage is prone to divorce. Therefore, to realize a harmonious marriage based on a functional structural perspective, it is necessary to balance the system to achieve this goal.

Legal substratum and social conditions of dissolution of marriage in Moldavia: comparative study (14th–17th centuries)

The main objective of the study is to show the specifics and features of the social phenomenon of divorce in medieval Moldavia. Divorce was known in all civilizations, however, in the context of European history, both common and specific features were observed in the Principality of Moldavia. The study of documentary historical, legal and act material of the era, notes and information of Catholic missionaries shows that in the Principality of Moldavia not only men, but also women had the right to divorce and remarry. Moldavian women could and had the right to initiate a divorce.

Cerai Talak dengan Alasan Virginitas dalam Tinjauan Hukum Islam dan Feminisme

This article is intended to explain the views of Islamic law and feminism on the phenomenon of divorce on the grounds that his wife was not a virgin from the start of her marriage. This research uses a doctrinal legal research approach as well as jurisprudence feminism. Data sources related to doctrinal legal research are in the form of Islamic legal norms contained in the treasures of fiqh, as well as fiqh which has been made into positive law in the form of the Marriage Law and Compilation of Islamic Law. The data source for the feminist jurisprudence approach is in the form of observations on the phenomenon of the rise of divorce cases in the Religious Courts on the grounds that the wife was not virgin before marriage. The results of the study show that there are similarities and differences in Islamic law and feminism in terms of virginity. In terms of similarities, both of them view that virginity is not always measured by the integrity of the hymen, but it is necessary to distinguish between sexual and non-sexual factors. However, from the other side, Islam views that a husband has the right to know about his wife's virginity from the start of marriage, whereas according to feminism a wife has the right to keep this secret. Divorce on the grounds of virginity can already meet the legal-formal fair criteria, but not morally.

Gender, Power and Subjectivity: Divorce of Chinese Migrant Women within a Transnational Marriage in Switzerland

Based on an empirical qualitative study, this article focuses on the life stories of three Chinese migrant women who have managed households with Swiss men, to demonstrate how they arrived at the point of divorce and how they reacted to social structures. This article also highlights that Sino-Swiss marriage-divorce is a transnational institution where different kinds of power relations intersect; the phenomenon of divorce in transnational marriages between migrants and local citizens is not so much a private affair, but rather a multidimensional social and political event in which immigration policies are involved. By analyzing both domestic and social violence encountered by Chinese women within transnational marriages in Switzerland, this article analyzes how different power relations such as gender, nationality and socio-economic class status determine the unequal positions of migrant women in claiming their rights during the divorce procedure. It examines how they react as subjects during the whole marital breakdown process with their Swiss husbands, both in terms of oppression and resistance. It argues that women within transnational marriages reconfigure their role and empower by subjectivizing within the intersection of different kinds of power relations.

Analisis Perspektif Masyarakat Terhadap Cerai Gugat Di Kabupaten Bekasi

Divorce is the end of a marriage with the severance of the relationship between husband and wife due to the failure to carry out their respective roles in fostering a household. In the view of the community that divorce is a way out of household problems that must be avoided because it is a disgrace to the family. The purpose of writing this article is to analyze the community's perspective on the phenomenon of divorce and lawsuits that often occur in the community. The writing of this article uses a qualitative approach, case study method with data collection through interviews with informants, literature review, and documentation. The results of the study show that the perspective of the people who are respondents in this study is related to the case of litigation that occurs in the community, something that is not good and the result of the divorce is that there will be divisions in the family. In the view of society, a woman must carry out her obligations as a wife and according to her nature to create a harmonious family, as well as a husband who must carry out his obligations as the head of the household, because marriage must be maintained in order to maintain harmony and maintain its sacredness.

Pertimbangan Hakim terhadap Perceraian Akibat Nikah Dini Masyarakat Manado

The phenomenon of divorce in early marriage often occurs in the Manado Religious Court, where there are 5 cases of divorce lawsuits at an early age. This study aims to show the factors that cause divorce in early marriage in the eyes of the judges of the Manado Religious Court. This research method is qualitative which focuses on field research. Data obtained at the Manado Religious Court in the form of reasons for divorce due to early marriage, both from the results of the decision and interviews with the judges of the Manado Religious Court. The results found are that divorce in early marriage at the Manado Religious Court is caused by several factors, namely bickering, irresponsibility, bad habits and a third person. Through the judge's consideration, that of all the factors that emerged led to quarrels, continuous quarrels and ended in divorce. So the judge judged that if you were to marry, it would be better to mature yourself as well as possible so that when problems occur in the household, they can be resolved properly without taking the divorce route.

TINJAUAN UNDANG-UNDANG DALAM PERCERAIAN DI LUAR PENGADILAN AGAMA

This study aims to explain the phenomenon of divorce outside the court according to Law Number 1 of 1974 concerning Marriage. In the context of positive law in Indonesia, the divorce procedure is regulated in a registered process. To avoid negative impacts, the Indonesian government issued a regulation that divorce can only be carried out in front of a court session. This research uses a qualitative phenomenological type of research with a case study approach and library research by conducting an assessment of the laws and regulations, books, and fiqh books related to the title of this thesis. The primary data in this study is qualitative data obtained through interviews and observations. The findings of the study indicate that the factors causing divorce outside the religious court in Rancagong Village, Legok District, are habits that often consider complicated procedures and stages in the divorce process at the Religious Courts, the unaffordable cost of the religious court process, the assumption that only the word divorce is legally binding. there is a direct legality of divorce according to religion (customary law), and the lack of information on the importance of a law in population status in Indonesia

A future educational role for the family to deal with the phenomenon of divorce in Jordan

The study aims to build a future educational role for the family to deal with the phenomenon of divorce that is by identifying the reasons leading to divorce from the point of view of divorced wives and husbands, the implications of divorce on both the wife and children, and the degree of difference in the reasons leading to divorce, according to gender, age, level of education and income for wives and divorced husbands in Jordan. The study population consisted of all divorce cases in the Kingdom in the last five years from 2012 to 2016, which number (24898) divorces. Based on this, the study recommends spreading awareness about the dangers of domestic violence and its repercussions leading to divorce, holding seminars on family issues and the rights of both husband and wife, and making them aware of the problems that both spouses may encounter.
