FINANCIAL ASPECT OF CYBERCRIME: SITUATION IN UKRAINE AND THE WORLD

Cybercrime is clearly linked with financial relations: for some, it is profit, for others – expenses or big losses. The article contains the research of the essence, causes, conse-quences and counteraction to computer fraud in Ukraine and countries of the world, as well as research of financial flows that accompany these processes. However, the authors tried to analyze quantitatively and qualitatively the dynamics of cybercrimes. It also focus-es on bodies that provide cybersecurity and normative legal documents in this area. The authors concluded that cybersecurity in Ukraine has not been sufficiently developed yet, which requires adopting the experience of cybercrime prevention in the advanced countries of the world and enhanced cooperation between international law enforcement agencies.

PLACE OF FORENSIC SCIENCE IN THE CYBERTHREATS PREVENTION SYSTEM IN FIELD OF A UKRAINIAN INFORMATION SECURITY

Theoretical developments and practical experience of countering cyberthreats in the field of information security of Ukraine are analyzed. It is determined that the crime prevention in the field of information security is structurally composed of several stages. They include: search for primary information on criminal activity in the information field ; prevention of cybercrime; detection of illegal actions in the field of information security while operative investigative activities and pre-trial investigation of criminal proceedings. The most common illegal actions in the field of information security is unauthorized tampering in the work of information and telecommunications systems. In order to identify these crimes during operative investigative activities within the criminal procedure operational officers and investigators must possess methods of detecting specified illegal actions and objects that can be subject to research. Theoretical bases of recommendations for search, detection, fixation and seizure of these facilities should be appropriate criminalistic methods. Legal basis for the formation of these methods should be legislative and departmental regulatory acts. However, in a number of normative legal acts related to ensuring cybersecurity in Ukraine, there are inconsistencies in the conceptual apparatus, especially with regard to specific object types of forensic science, signs of unauthorized tampering in the work of information and telecommunications systems. It was found out that counteraction to cyberthreats in the field of information security in Ukraine should be based on a system integrated approach to use of all structural elements, coordination of its subject activities including forensic experts. The theoretical basis for the formation of a system integrated approach to crime prevention in this field is the implementation of research on research of theoretical applied branches of jurisprudence: criminalistics, theory of forensic science, theory of operative investigative activities.

CYBERSECURITY AS A NEW DIRECTION OF THE INFORMATION COMPONENT OF NATIONAL SECURITY OF UKRAINE: CONSTITUTIONAL LEGAL ASPECT

The article is devoted to defining the place of cybersecurity of Ukraine, as the latest trend of information component of national security system of Ukraine, which is based on provisions of the Constitution and legislation of Ukraine. The main reasons for the development of the concept of cybernetic security of Ukraine should include the emergence of challenges and threats in information and cyberspace in the context of rapid development of scientific and technological progress of mankind. It is also essential to add that in the conditions of the armed aggression of Russia against Ukraine, the question of protection and its legal reasoning from the point of view of the Constitution of Ukraine with the aim of protecting state sovereignty and independence of the Ukraine is extremely urgent. In the article the special attention is paid to appearance and development of the term "cybersecurity". The approaches of Ukrainian scholars to determining the cybersecurity from the legal point of view are analysed. As the basis for the system of national security of Ukraine, the rules of the Constitution of Ukraine define the fundamental focus on the protection of cyberspace and critical infrastructure of Ukraine. It is important to note that the implementation of the cybersecurity of Ukraine is the protection of the rights and freedoms of man and citizen in Ukraine, the interests of society and the state, effective functioning of bodies of state power, of the ability to confront the challenges and threats in the sphere of high technologies. As well the author considers the problems of determining the informational sovereignty of Ukraine, identifies and consolidates its legal features, including cybersecurity, which is included as part of the overall information security policy in the system of national security of Ukraine. Special attention is devoted to the recently adopted normative legal acts in the sphere of implementation of cybersecurity in Ukraine, which define the essence and the concept of cybersecurity, the basic principles and tasks for its implementation in Ukraine. The article as well defines the characteristics of the national system of cybersecurity in Ukraine. The basic principles of activities, tasks, and limits of competence of the relevant entities ensuring the implementation of cybersecurity in Ukraine are analysed. In conclusion the author singles out the main norms of the Constitution of Ukraine that recognize cybersecurity as a part of the information component of national security of Ukraine.

CYBER SECURITY IN THE MODERN SOCIATION AND IMPROVEMENT OF PREPARATION OF FUTURE FACTORS IN THE FIELD OF COMPETENT APPROACH

Trends in the development of higher professional education in the conditions of the information society confirm its transformation in accordance with the expansion of the spheres of professional activity and education related to the significant dynamics of the development of the information component of human life and society. The state of the development of the information society and information infrastructure of Ukraine determines the professional requirements of public and private structures for the training of specialists in the field of information security and information-psychological confrontation of technical, humanitarian and economic specializations. These areas of professional activity have been developing significantly in the last three decades, and the sphere of cyber security since the 2000 (with the notion of the national system of cyber security in Ukraine legally determined only in 2016). The content of the concept of cybersecurity covers not only technology, but above all human resource. Today, the majority of representatives of agencies involved in the national system of cyber security of Ukraine, note the urgency and the need for proper staffing by professionals of the relevant specialization. Theoretical analysis, generalization and definition of the role of cyber security in modern society and training of future specialists of the branch in higher educational institutions, tendencies of modernization for organization of educational processes on the basis of competence approach, system analysis of legislative, normative and regulatory basis, pedagogical experience of professional training of future cybersecurity specialists in higher education institutions. The scientific and technological revolution has caused deep system transformations around the world. First of all, due to the improvement of achievements in the field of the latest information technologies with the assets that arose on the basis of the rapid development of information and telecommunication systems, fundamentally new comprehensive issues – the information society, as well as informational and cybernetic spaces, which today cover virtually unlimited potential and play a leading role, have been formed, role in the economic and social development of each country in the world

The System of Cybersecurity in Ukraine: Principles, Actors, Challenges, Accomplishments

Perceiving cybersecurity as one of the priority areas of national security is common among both developed and transitional states in today’s globalized and digitized world. This is particularly relevant for the relatively young Independent state of Ukraine, which has during the last years repetitively fallen victim to many instances of high-profile malicious activity in cyberspace, the so-called “cyberattacks”. In response, starting in 2015, a number of policy reforms aimed at developing the system of cybersecurity have begun to be implemented. Based on Ukrainian normative acts, the author attempts to describe the perception of cybersecurity, its defining features, the key principles of its provision, the system of actors that are involved in it, and the directions of sectoral policies, as well as their concrete measures. Furthermore, the article notes down the achievements that have already been reached and underlines the key challenges that are still to be overcome. Finally, the case study of Ukraine allows reaching some generalizations with regard to the approach of a state to establishing the functioning of this area of national security.

The article examines trends in the development of legal regulation of information security in Ukraine in the context of the implementation of the Association Agreement between Ukraine and the European Union. The current information legislation and regulations on information security are analyzed. The tendencies in the legal regulation of information security that took place at the initial stage of the formation of information legislation are revealed. Based on the factors that took place before the adoption of the Doctrine of information security of Ukraine, the laws of Ukraine “On the basic principles of ensuring the cybersecurity of Ukraine”, “On the national security of Ukraine”, in the context of the current legislation, based on the methodology of legal forecasting, it is concluded that in the future the development of normative legal information security will be developed on the basis of by-laws, mainly at the departmental level.

Recommendations for cybersecurity strategy of Ukraine development

The problem of cybersecurity is quite acuted in all states of the world in different levels of social life. Using of informational resources is necessary for normal functioning of various sectors of the economy. It is important to secure information that circulates in such systems, at the appropriate level. The research of level of cybersecurity in Ukraine and examples of its importance are presented in this paper. The analysis of cyber security strategies of the various states of Europe, America, Africa, Asia and Oceania, investigated the term «cybersecurity» from the context of these documents were done. The problems of modern national legislation regulating the activities in the sphere of cybersecurity were highlighted. Also the causes of the first cyber security strategy was studied, and also modern trends in the cyberspace security were analyzed. According to the results, practical recommendations for creating the national cyber security strategy of Ukraine were proposed.

Cybersecurity in Ukraine: Problems and Perspectives

The paper outlines the challenges and the main cyber threats (such as cybercrime, cyber terrorism, cyber war, vulnerability of the state’s information infrastructure, unsatisfactory level of information security) in the Ukrainian cyberspace. Further, a classification of the negative impact of cyberattacks on critical information infrastructure is offered. The authors present Ukraine’s cybersecurity strategy and policy, and describe the country’s cybersecurity system, legal and regulatory aspects, and related specifics of Ukraine’s educational system.
