A construction contract is a civil contract agreed in writing between the principal and the contractor to perform part or all of the work in construction investment activities. Construction contracts include many different types, corresponding to stages and tasks in the construction process of a project. However, no matter what type of contract it is, it must comply with some basic legal issues that are the foundation of construction contracts. During the contract implementation process, the role of management is extremely important. The purpose of this study is to analyze several policy mechanisms in construction contract management and identify factors affecting construction contract management, and some inadequacies in construction contract management, from there, propose some solutions to improve construction contract management according to Vietnam’s law.

THE SUITABILITY OF EXISTING CONSTRUCTION CONTRACTS FORMS FOR BIM CONSTRUCTION PROJECTS

Numerous major construction projects suffer from cost and schedule overruns. In addition, the potential for conflict between project participants, for example due to changes in performance, additional services or ambiguities in the contract, has increased substantially in recent years, while at the same time the ability to resolve conflicts quickly has declined significantly. In the context of digitization, Building Information Modeling (BIM) represents a way of implementing projects more efficiently and satisfactorily for all parties involved. With the method, "risks can be significantly minimized, construction times considerably shortened and costs noticeably reduced". In order to make the most of the advantages of the BIM method, the choice of a suitable form of construction contract is of decisive importance. Within the research conducted at the University of Wuppertal, characteristic features of conventional and alternative forms of construction contracts as well as management concepts were examined and the respective advantages and disadvantages were compared with regard to the criteria identified. In addition, the construction contract forms and management concepts were also examined and evaluated for compatibility with the BIM method. The result of this investigation shows a scoring model. It includes both the nationally established construction contract forms of individual award with unit price contract as well as alternative forms such as the Framework Alliance Contract-1 with the concept of value engineering. The result of the study should encourage clients to consider alternative forms of construction contracts in order to be able to design construction projects more efficiently.

Factors of Project-Based Teaching That Enhance Learning Interest: Evidence from Construction Contract Management Course

Construction contract management is an important research field in engineering. However, in construction contract management courses, student learning interest is decreasing because of unreasonable course design and management. Consequently, the use of project-based teaching (PBT) has increased in recent years. Nevertheless, there has been little research conducted to provide evidence that highlights the role of PBT among the factors of learning interest. This study aimed to investigate the factors that promote learning interest in PBT courses. First, we identified research gaps with a literature review and developed a potential research model. Second, a PBT course was carried out where 71 Tsinghua University students who attended the course were surveyed via 5-point Likert-scale questionnaires. Third, data were analyzed using the Wilcoxon signed-rank test and the ordinal logistic regression model. Finally, the results were interpreted and discussed. Our findings show that there is a significant improvement in students’ learning interest towards the related course after the PBT method was adopted and that pedagogical factors, specifically (1) curriculum scope and sequence, (2) collaboration and communication, and (3) workload are the most salient factors that can influence student learning interest. None of the dispositional factors were found to significantly affect student interest. These results underpin the theoretical validity of PBT and can be used to improve PBT in engineering education management.

Evaluation of Construction Contract Management in the Nigerian Construction Industry

Construction projects in Nigeria are most of the time not completed within schedule, cost and quality specifications and at times project abandonment. In evaluating the construction contract management practice in Nigeria with the objective of ascertain the tendering methods, usage of construction document and the common techniques used in construction planning. One-way analysis of variance and multiple regression analysis were used in the analysis. The analysis of the respondent score relating to hypothesis for using regression model showed the regression equation as Y=10.43983+0.7525x1+0.3419x2+0.5256x3+0.1874x4. The coefficient of multiple correlation (R) was 0.909124 and this means that 91% positive correlation exist between the successful implementation of construction contract. The independent variables explain 83% of the variables in successful implementation of construction contracts and the remaining 17% could be attributed to other unspecified factors.

Towards Adoption of Smart Contract in Construction Industry in Malaysia

The revolution of Malaysian Construction 4.0 through emerging technologies has brought a paradigm shift that has digitalized the construction sector. There is a need to adopt a computerized protocol to assist in automating the performance of a contract to meet future digital challenges. Therefore, this paper aims to serve as a pioneer study to investigate the implementation of the Malaysian construction industry to adopt smart contracts. This study adopted a qualitative scientific methodology, whereby a systematic review was conducted to gather the benefits and challenges of implementing smart contracts in the construction industry. Further, interview sessions were arranged to collect data from the construction contract management experts. The research findings unveil that due to the self-executing attribute of smart contracts, the implementation of smart contracts could provide a better apportionment of risks in a contract. The study also finds that the challenges in implementing smart contracts are severe. For instance, the smart contract is irreversible and immutable and prone to human error. The study concludes that it is more suitable to apply and implement a smart contract to a short-term contract that is not subjected to variation. Furthermore, a smart contract can enhance the efficiency in managing the contracts, such as reducing time and managing the conflicts and disputes that arise during the contract duration. The developed implementation framework is significant for the construction personnel, especially those dealing with the contract administration. The implementation of smart contracts in construction could boost contract administration and management discipline via investment in this new technology.

Impact of COVID-19 on project performance in the UAE construction industry

PurposeThe coronavirus disease 2019 (COVID-19) pandemic has affected the global economy and, thus, the global construction industry. This paper aims to study the impact of COVID-19 on construction project performance in the United Arab Emirates (UAE).Design/methodology/approachThis study adopted a qualitative and exploratory approach to investigate the impact of COVID-19 and its policies on project performance in the UAE construction industry in critical areas of the project management body of knowledge (e.g. schedule, cost, resources and contracts). Semi-structured interview questions were asked from ten construction professional to obtain valuable insights into the pandemic’s effects on the UAE construction industry and the effectiveness of policies implemented to rectify the damage and identify the industry’s new normal.FindingsThe findings indicate that the construction industry faced several challenges such as schedule delays, disrupted cashflows, delayed permits, approvals and inspections, travel restrictions, serious health and safety concerns, material and equipment shortages, among others which hindered the timely delivery of construction projects. It also indicates that efforts made by the government institutions and the construction industry of the UAE such as economic support programs, digitization of processes, fee and fine waivers, health facilities, among other statutory relaxations proved effective in supporting the construction industry against the adverse effects of the pandemic.Research limitations/implicationsThe research findings are limited to the literature review and ten semi-structured interviews seeking an expert’s opinion from industry professionals working in the UAE construction industry. The research team did not get access to project documents, contracts and project progress reports which may be required to validate the interview findings, and to perform an in-depth analysis quantifying the impact of COVID 19 on construction projects performance, which is a limitation of this research.Practical implicationsThe implication is that, owing to the imposed lockdowns and strict precautionary measures to curb the rapid spread of the pandemic, smooth execution of the construction project across the country was affected. The government institutions and stakeholders of the construction projects introduced and implemented various techniques and solutions which effectively handled the implications of the COVID-19 pandemic on the construction industry of the UAE.Originality/valueThis study has identified the challenges faced by the construction industry of the UAE in the context of the management of project schedule, project cost, construction contracts, health and safety of construction employees and other related aspects of the construction projects. This study also identified the techniques and solutions adopted by various public and private institutions of the country and their implications on construction projects. Therefore, this study provides guidelines for policymakers and future research studies alike.

Feasibility studies, planning, pricing and contract management in the construction industry depend mainly on the stability of the economic process where most infrastructure projects require relatively long periods of time to implement them. In a highly inflationary economy where foreign exchange rates constantly change compared to the local currency for long periods that may extend for years. In such an economy, the prices of construction materials vary according to market variables. The methods of pricing items in bids are not feasible for profit and loss accounts and for competition purposes, which leads to significant complications in the management of construction contracts associated with these projects and generates a new case of continuous change unprecedented and has not been resolved even in the global construction contracts of FIDIC. The researcher monitored and collected the inflation values and the exchange rate of Sudanese pound against US dollar as the main currency for a large number of years against the prices of cement for the same years and then statistically studied through a number of statistical analysis programs. Information has been studied over time and then the change in the price of cement versus inflation and the exchange rate and a try to devise a function has been carried out in order to describe that change and express it in a mathematical formula that facilitates reading, analyzing and forecasting. It was found that the change of cement prices is related in a logarithmic function with both inflation and the exchange rate. The independent explanatory variables (exchange rate and inflation rate) were found to be responsible for at least 80% of the changes in the dependent variables (cement prices). The remaining 20% is the impact of other (random) variables not included in the model, and this is an indication of the quality of the documentation of the model. That the variables included in the model is the most influential in the dependent variable of non-included variables. The mathematical models have passed derived economic and standard criterion and have been acceptable statistically and can therefore be relied upon to test any hypotheses are developed.

ИССЛЕДОВАНИЕ ПРОБЛЕМ УПРАВЛЕНИЯ ГЕНЕРАЛЬНЫМ ПОДРЯДОМ СТРОИТЕЛЬСТВА ОБЪЕКТОВ НА ОСНОВЕ BIM-ТЕХНОЛОГИЙ В КНР

In recent years, the global construction market has been developing rapidly. In particular, China's construction industry is becoming more mature. BIM technology is being widely implemented for the implementation of investment and construction projects (ISPs), the effectiveness of which has also increased in the construction industry in China. BIM technology covers the entire life cycle of an ISP, but, at the same time, rarely includes the processes of managing contracts and costs of construction projects. Consequently, the issues of timeliness of the current contract, medium-term payment and other important aspects were not resolved in the ISP. Thus, many scientists and experts in China and abroad have proposed to study the general construction contract management model based on the BIM model platform to solve the problems of performing general contracts and related contract management issues. This article uses the method of literature review in combination with the analysis and research of construction projects in China through the study of the current state of general contracts and the application of BIM technology in contract management. Warranty conditions for the use of BIM technology are put forward, a model for monitoring the construction period of an object based on BIM technology is established, and a system for exchanging information in contractual relations based on BIM technology and the IPD model is established. All of the above establishes a model for managing an investment construction project based on BIM technology and the IPD model. A basic model of the remuneration mechanism for the implementation of ICP in the IPD model is also proposed. The results of the analysis of the implementation of investment and construction projects and the use of BIM technology show further prospects for its development when implementing ICP in the IPD model.

Assessing contract management as a strategic tool for achieving quality of work in Ghanaian construction industry

PurposeThis study aims to investigate the attainment of quality in Government of Ghana’s (GoG) infrastructural projects through effective contract management and especially, relating to qualification, competence and experience of supply chain stakeholders.Design/methodology/approachA survey questionnaire and field observations were used to collect primary data from staff of the education ministry and construction professionals. Documentary analyses of contract documents were also undertaken.FindingsThe results show that executing agencies’ failure to apply appropriate contract management processes was linked to the gap between stakeholders’ knowledge and actual practice. This was confirmed by Spearman’s rho tests of correlation between overall mean ranks given by professionals and non-professionals, which indicated strong agreement between those groups. Factors such as contractors’ engagement of unqualified supervisory staff, lack of proper projects monitoring and evaluation by executing agencies mainly contribute to the poor quality of work.Research limitations/implicationsInvestigations were limited to the Funds and Procurement Management Unit of the Ministry of Education, Metropolitan, Municipal and District Assemblies and local contractors. Nonetheless, the methodology used could be used in future studies to analyse the socio-economic implications on the quality of education infrastructure.Practical implicationsConstruction is booming in Ghana but the capacity to improve the work quality through effective contract management is limited. However, with the effort of stakeholder and statutory bodies’ support in capacity building initiatives, GoG projects could offer some novel solutions to improve quality of work.Social implicationsConstruction industry professionals and students’ knowledge and perception on construction industry and contract management is significantly improved.Originality/valueThis study provides information on respondents’ knowledge on contract management process, which, if not properly understood, can lead to poor quality of work and loss of money.
