This article intends to investigate the distinction between an act of administrative improbity and a merely illegal act. To this end, it will delve deeper into the notions specific to Criminal Law, embodied in the conception of permitted risks and prohibited risks. The administrator's right to error will also be addressed. At the end, final considerations will be made, as a form of conclusion about the context investigated, in which it will be possible to verify the possibility of the applicability of such theories also in the context of administrative improbity. The methodology of the study, inserted in the dogmaticlegal aspect, is based on the study of bibliography, legislation and jurisprudential understandings on the topic.

This text presents a contribution to the analysis of the possible rise of authoritarian regimes in the contemporary world. From the examination of Franz L. Neumann's book, "Behemoth", in dialogue with texts by Karl Lowenstein and Bruce Ackerman, all jurists, the text shows that the implementation of totalitarian regimes implies the collapse of the separation of powers by a concentration of power in the Executive. The implementation of totalitarian regimes therefore has a necessary legal-institutional component, in addition to economic, political, social, and psychological factors.

El principal aporte del principio de precaución es que refuerza los estándares legales de proteccion del riesgo y conduce a un manejo ordenado e inteligente del mismo. Este principio fue introduciéndose de manera progresiva tanto en los ambitos nacionales como internacionales ante la posibilidad de presentarse un potencial riesgo o peligrosidad referidos al ambiente y a las condiciones de vida de la humanidad principalmente en la sociedad post industrial. En ámbitos internacionales, su inclusión en los Tratados de integracion y comercio conduce a un manejo sostenible de los intercambios.
