The Effect of Covid-19 Pandemic on Personal Health Data in Terms of European Union Law and Turkish Law
  • Jan 1, 2022
  • Turkish Journal of Bioethics
  • Seden Dürüstkan

As epidemics in the history of humanity are experienced in the age of technology, the solutions that humanity has found in order to prevent the spread of diseases have started to change. This new state of humanity, which has started to conduct its relations through mobile applications, is also trying to protect their health with these applications. Mobile tracking applications, which entered our lives with the Covid-19 pandemic, have brought a new approach to the transmission of the disease, necessitating the need to re-discuss two sometimes conflicting concepts such as privacy and public health. In addition to the complementarity of the relations between the individual and the public, the need to keep them in balance has gained a new dimension with the pandemic. The mobile tracking applications, which started to be used to prevent the spread of the epidemic, were examined by comparing them with the European Union law and Turkish law regulations, and the perspectives of the laws on the autonomy and privacy of individuals based on personal data were evaluated when it comes to public health. Because even though mobile tracking applications have entered our lives due to the pandemic, the doors to the possibilities of finding a place for them in other areas have been opened from now on.

  • Ezgi Şiir Kıbrıs

The allocation of limited resources and the fair treatment to patients are among the important bioethical issues addressed in the treatment of coronavirus. This study analyzes the relationships between COV-ID-19 recovery rate and ventilator allocation time and demographic variables such as gender, race, age, and insurance status. In this study, the data on coronavirus patients of a hospital in the USA were used. Machine learning methods including Random Forest, Decision Tree, Support Vector Machine and Logistic Regression algorithms were utilized to model the data. As a result, that patients covered by Medicaid insurance, which benefits the poor people in the US, are less likely to survive as a result of coronavirus. This result is important in terms of discussing the relationship between health insurance and bioethics.

The Analyse of Forensic DNA Databanks within The Human Rights Dimension
  • Jan 1, 2022
  • Turkish Journal of Bioethics
  • Zeynep Reva

This study aims to analyse the forensic DNA banks with the medicolegal and human rights dimensions within the framework of comparative law. Methodology: The study is based on a systematic review and analysis of research and data in the literature. The literature review was conducted using the words 'forensic DNA bank' and 'biobank ' in 'Google Scholar' between July 2018 and November 2018. Findings: DNA profiling has a key role in fighting and solving the crimes especially in the homicide and sexual assault crimes. DNA database provides a significant evidence not just in catching offenders but also exonerating the innocent. DNA databanks are being created in many countries which are aware of the power of the DNA data as an extremely strong evidence. The DNA data banks, which include DNA data obtained from convicts, suspects and the crime scene, increase the likelihood of success in criminal investigations. However, DNA data banks provide significant benefits for the analysis of forensic cases, they cause hesitations due to the potential risks they may have in terms of personal data privacy, human rights and freedoms. Conclusion: The development of forensic genetic studies and DNA analysis through technology has led to discussions on creating DNA databanks and the limitations of these rules and regulations. The issue should be addressed not only with its medical, ethical, and legal aspects but also with regard to the fundamental rights and freedoms.
