This paper seeks to reflect on a cross-cutting issue that permeates various family processes involving the rights of a child or adolescent, namely the right of a minor to procedural participation and legal assistance. To this end, the subjective conditions for exercising the right to legal defense for children and adolescents under Argentine law will be analyzed, seeking to delve into the main arguments of the different existing positions regarding the question of when the appointment of a child's attorney is appropriate and, based on this, to determine which are consistent with the current system.

This paper will address the legal implications of a mathematical formula that allows an objective, precise and scientifically validated calculation of physical disabilities; the development of such an algebraic equation finds enough mathematical support and records scientific background determining its feasibility for its application in damages law, with benefits for the justice system, for the injured parties and for the insurance system in general, opening up a wide field of use in conflict resolution, both at judicial and extrajudicial stages.

There are seas of ink and heated debates surrounding this assisted human reproduction technique, which represents a conceptual shift in the definition of motherhood. Surrogacy raises global controversies, and its growing acceptance challenges traditional conceptions of motherhood, filiation, and family. Questions about the role of women and gestating bodies provoke conservative reactions as well as criticism from feminist perspectives. Through a qualitative examination of conventions, jurisprudence, and communication materials from European and Inter-American organizations, we will critically analyze the discrepancies between different legal systems of the international community regarding the challenges of reaching a consensus that protects minimum standards of rights and ensures their continuity in cross-border situations through the inescapable gender and human rights perspective required by this concept.

In this paper, I analytically address several points of the recent reform to the pension system of the Retirement, Subsidy, and Pension Fund for Personnel of the Bank of the Province of Buenos Aires. Specifically, I select certain provisions of Law 15.514, namely, retirement age, benefit accrual, determination of the starting salary, salary readjustment, and mobility. For the analysis, I draw on current and outdated legal sources, as well as case law. After an individual study of these points, and within the scope of the new law and conclusions, I explain that, in my view, the recent reform has aspects that improved the previous system, but also some others that should continue to be worked on.

En este artículo se analiza la metamorfosis del Estado constitucional contemporáneo a partir del concepto de “Estado de Derecho”, abordándolo no como una categoría fija sino como una noción histórica en transformación. A través del enfoque de conceptos-función, se estudia cómo dicha noción ha dejado de fundarse exclusivamente en garantías y límites soberanos para articularse en torno a formas de gobernabilidad regulada. Se examinan las mutaciones normativas que introdujeron principios programáticos en las constituciones -como en la Ley Fundamental de Bonn- y su funcionalización dentro del orden económico. A partir de las teorías ordoliberales y neoliberales, el texto describe el pasaje de un Estado proveedor hacia un Estado regulador, así como la transformación del sujeto jurídico desde ciudadano soberano a consumidor productivo, sometido a las reglas del mercado. También se explora la expansión de este modelo al plano global, a través de la biopolítica, la gubernamentalidad y el desplazamiento del campo de intervención jurídica hacia la “humanidad” como categoría funcional. Finalmente, se reflexiona sobre la aplicación de este paradigma en el contexto latinoamericano, y particularmente en la Constitución Argentina de 1994, en la que coexisten retóricas democráticas con estructuras normativas liberales. El artículo concluye que el Estado de derecho ha mutado hacia una arquitectura normativa dispersa, orientada por la eficiencia regulativa más que por la representación política.

The recently approved Code of Administrative Litigation is the first regulatory compendium with the value and form of Code that regulates administrative litigation in our country and it is The result of years of hard work and legislative projects contumaciously labeled as failures. The need for a regulatory framework in Administrative Law, both in its procedural and fundamental aspects, was a constant claim from said Law branch`s operators in every area, from the Academy to Practitioners. This study is a first approximation to the new Code, more precisely it is a first reading as it may include comments that might need a future review in light of the passage of time and the application of the Code by practitioners. In this study the Code is analyzed as a whole, without an exhaustive and deep analysis of each Title. Rather it is an overview of the Codet, fundamentally in relation with the new guarantees established for the interested parties, then concluding with the first successes and failures of the Code.

This paper explores the origin, evolution, and functions of the Roman praetor as a key figure in the administration of justice from the Republic to the Late Empire. It analyzes the role of Iuris dictio and Ius edicendi, through which the praetor complemented or corrected the ius civile, giving rise to honorary law (ius honorarium). The research highlights how this magistracy, initially restricted to patricians, was gradually opened to plebeians after the Liciniae Sextiae reforms of 367 B.C. The study also examines the phenomenon of cooptation, which limited access to power through elitist and clientelist mechanisms, and evergetism, understood as the practice of public donations by magistrates. The text concludes that although the praetorship was central to the shaping of Roman law, its prestige and functions diminished with the consolidation of imperial power and the codification of the Edictum Perpetuum under Emperor Hadrian, leading to its virtual disappearance as an effective judicial institution.

The principle of inexcusability requires that judges -regardless of the potential silence, obscurity, or insufficiency of the laws- always issue a judgment that resolves the issue that has been brought before them. This article intends to investigate whether such duty should be eased after considering other issues. The issues raised here (which are not the only ones, but which are sufficient to point out the omissions incurred when addressing the matter) begin with a linguistic clarification and derive towards the imprecision that may affect the rules and, with it, towards systemic questions of interpretation. All this aims to show that the principle of inexcusability must be more scrupulously considered and to anticipate that the results that may be obtained will influence issues such as the possibility for judges to issue rulings; the characteristics of coherence, consistency, and completeness of legal systems; or the exercise of discretion.

The ruling on the Necochea port tax not only resolved a tax dispute but also set a precedent regarding the taxing power of municipalities vis-à-vis large export corporations. After years of litigation, the Administrative Litigation Chamber of Mar del Plata upheld the tax and recognized the municipal right to tax activities that impact its territory. The ruling reinforces local fiscal autonomy and raises a central question: how far does the taxing power of municipalities extend vis-à-vis transnational actors? This case, analyzed from a political economy perspective, exposes the tension between local development and economic concentration. Furthermore, it invites us to rethink the taxing powers of municipalities exposed to transnational capital and the role of the judiciary in these disputes.
