Abstract

To address the increasing problem of toxic substances, Congress enacted the Toxic Substances Control Act (TSCA), in 1976. It established the national policy that: “adequate data should be developed with respect to the effect of chemical substances and mixtures on health and the environment and that the development of such data should be the responsibility of those who manufacture and those who process such chemical substances and mixtures.” TSCA Section 2(b)(1) It's no wonder that this Federal statute is difficult from a compliance perspective. In 1976, it was not known how many chemicals were in commerce in the United States, in what quantities, or where they were being manufactured or imported from. The current inventory based on data gathered numbers approximately 82,000 chemicals. And to many people, any chemical is a toxic substance.
