Abstract

The events taking place in Ukraine have greatly aggravated not only the issue of ensuring the combat capability and functioning of theArmed Forces of Ukraine and other military formations, but also significantly actualized in society the issue of social and legal protection of servicemen and their family members. The purpose of the article is to investigate the social guarantees of family members of military personnel in the field of social protection in today’s realities and to identify ways to solve problematic issues. The definition of the legal category “social guarantees of family members of military personnel” is provided (as defined in the current legislation and supported by an appropriate financial base, social security indicators that manifest as appropriate constructions of subjective rights in the field of social security, quantitative and qualitative characteristics of social payments, benefits, benefits, advantages developed taking into account the actual state of social relations and in accordance with the requirements of international standards in order to ensure a decent standard of living of members of military servicemen’s families) and the essential legal features and features of social guarantees of military servicemen’s family members are highlighted. It is noted that today the social protection of family members of military personnel in the conditions of armed aggression of the Russian Federation against Ukraine is gaining special importance. Because ensuring their enhanced social protection contributes to the fulfillment by military personnel of their duty to protect Ukraine, its sovereignty, independence, and territorial integrity. It has been established that the state is already taking certain steps in this direction, but there are many issues that need immediate resolution. In particular, analyzing the normative legal acts of Ukraine, which reveal the essence of providing social guarantees for members of military servicemen’s families, it is noted that they do not take into account the current standard of living and costs, in contrast to foreign countries, where this issue is given considerable attention. In particular, in order to ensure social guarantees, most countries of the world implement a whole set of state measures aimed at ensuring a decent standard of living and a satisfactory well-being of members of military servicemen’s families. It was concluded that the regulatory and legal settlement of the issues of providing social guarantees for members of military servicemen’s families should be based on international standards, provided that the domestic specificity of the social security system is preserved.
