Abstract

The issue of lawful authority is examined in the context of the non-self-defence based use of lethal force by military forces in law enforcement operations. The nature and limitations of a 'lawful authority' defence of 'reasonable and necessary force' for statutory purposes is analysed using the U.K. experience and its relevance in the Australian context.
