Les auteurs et victimes d'inceste peuvent-ils vraiment s'engager dans un mariage valide ? Voila une question dont la reponse est importante pour un canoniste, car le phenomene de l'inceste est assez repandu et affecte profondement la personnalite des individus. Comment repondre a cette question sans bien connaitre et la nature de l'inceste et tous ses effets - psychologiques, physiques, comportementaux et sexuels - sur l'auteur et sa victime ? C'est bien ce que fait d'abord l'A. dans les deux premieres sections de son article. Elle aborde ensuite la jurisprudence rotale avec quatre causes de declaration de nullite de mariage jugees en vertu du c. 1095, sans oublier de montrer quels autres chefs auraient pu amener eux aussi un jugement. En conclusion, elle nous offre une serie de criteres qui aideront le tribunal a juger de la validite de ces mariages, qu'il s'agisse de l'homme, habituellement auteur de l'inceste, ou de la femme, plus souvent qu'autrement la victime, dans son âge, d'un pere incestueux. En annexe, l'A. nous presente deux sections in iure, l'une portant sur l'auteur de l'inceste et l'autre portant sur la victime

Marriage and Sexual Regulation in Ford's 'Tis Pity She's a Whore

This paper interprets John Ford's play, 'Tis Pity She's a Whore, in the context of the sexual regulation of the day, which was predicated on holy matrimony. Anyone engaging in a sexual relationship outside of marriage was threatened with divine punishment. This interdiction was internalized by people through the panoptic mechanism sustained by the discrepancy in knowledge and visibility between God and man. This panoptic control of the mind was complemented by the actual penalty-public penance-which was aimed at the sexual offenders' eventual submission to the regulation. Given this context, Ford's allegiance to the orthodox sexual mores of his day can be seen in his accentuation of the all-encompassing regulative power in this play. In spite of his incestuous and atheistic posturing, Giovanni remains subject to panoptic control in his initial attempt to constrain his incestuous desire, his application of God's principle in censoring himself, and, at the end of the play, his dual roles as the agent and object of God's vengeance on sexual offenders. The incestuous couple's subjection to sexual regulation is revealed in their attempt to legitimize their relationship by establishing a matrimonial bond and also in their acquiescence to Annabella's marriage to Soranzo. In contrast to Giovanni, Annabella has a strong tendency to submit to sexual regulation; she eventually reconciles with God by undergoing public penance and an orthodox preparation for death. While experiencing the play, Ford's audience was also penetrated by the same panoptic mechanism, and made conscious of God's invisible but omniscient surveillance.

Uma Releitura do Incesto Diante de um Novo Contexto Sociofamiliar

This article, which adopts the literature search methodology aims to analyze reasons for incest to be considered a universal law as well as an interdict necessary for life in society, and, from this perspective, presenting a new vision for matrimonial impediments linked to Relatives. Therefore, is realized a study of motherhood and fatherhood as a function and the way that marital impediments were established in the Brazilian legislation, questioning whether they are compatible with the true role that each individual plays within the current family context. Finally, it demonstrates the necessity for a review on current incest rules, on the grounds that it was a law created to maintain group life, this requires a convivial and social relations between members of the group, to such prohibitions that make sense and are recognized as valid for them.

TRAPPED IN THE IN-BETWEENNESS: THE NARRATION OF GENDER, SEX, AND SEXUALITY IN JEFFREY EUGENIDES’ MIDDLESEX

The 2003 Pulitzer Award ’s winning novel Middlesex has been praised in the United States because it is considered to be successful in presenting new perspectives on gender through intersex character who rejects genital surgery. In addition to intersex, this novel also constructs the discourse of sexuality through incest and lesbian issue. This study is conducted to reveal how gender, sex, and sexuality are represented in the novel. Judith Butler’s concepts of gender, sex and sexuality are used in this study to understand how the author builds the discourse of incest, lesbian and intersex. In order to find out the author’s position regarding these issues, this study also aims to expose what factors have influenced the representation of gender, sex, and sexuality in the novel. The result of this study shows that this novel tends to strengthen the causality between gender, sex and sexuality by portraying lesbian and intersex as the other . Incest is depicted as something acceptable as long as it is successfully blurred the kinship and suggests consensual heterosexual relationship. While lesbian is represented as sexual deviant desire that is never accepted in the United States. Intersex which becomes the major issue of the novel is defined as an abnormality that is shameful and should be hidden. In order to be accepted in the United States, lesbian and intersex are required to transform into more coherent gender and sexuality to fulfill what Butler calls as compulsory heterosexuality . The representation of gender, sex, and sexuality in the novel are greatly influenced by the political, social, and cultural factors that developed in Greece, the United States, and Germany in the 20 th up to the beginning of 21st century. Furthermore, the discourse of lesbianism and intersexuality that flourished in America when the novel was published also has an effect on the representation of lesbian and intersex in the novel. A thesis on customary law of Buddhist marriages in British Burma

Under section 13 of the Burma Laws Act ( XIII of 1898 ), the Courts in British Burma must apply the Buddhist Customary Law to certain specified matters including Marriages where the parties to any suitor proceeding are Buddhists, except in so far as such l aw has by enactment been altered or abolished, or is opposed to any custom having the force of law. Marriage la s are contained in the Dhammathats which are not statutes. They prob bly stated what the la s were when they were compiled or hat t hey should have been in the view of the authors. In the Burmese Courts, the Judges consulted them or some of them, but did not regard their dicta as binding. The task of the Courts in British Burma has been and still is to deduce from the ad hoc decisions compiled in the Dhammathats, general principles of the Customary Law in accordance with modern habits and customs of the Buddhists. Only in t hese Courts is an attempt made to balance one against another and to accept the result as a rule of decision. The writer has pointed out errors in decisions arising from inaccurate English translations of the Dhammathats. The Introductory Chapter contains a brief study of Burma, and the Burmese as a nation. The subject is divided into Chapters on nature of Customary Law, Tests of customary Law, Proof of Custom and Usage, Extent of Application of Burmese Customary Law , Dhammathats, Matrimonial Courts, Burmese Buddhist Marriage, Marriage, Consent of Parents and Guardians, Consummations of Marriage, Proof of Marriage, Wives , Restitution of Conjugal Rights, Marriage with Foreigners, Maintenance, Effect of Marriage on Property, Divorce, Partition on Divorce, and Effect of Divorce on Children. As the title plainly suggests, the thesis deals only with the Customary Law as administered by the Courts established after the British annexation of Burma.

Nuestra sociedad plural se enfrenta al reto intercultural que exige del Trabajo Social una respuesta ante las nuevas necesidades sociales a nivel individual-familiar, grupal y comunitario. Ante estas realidades, el trabajador social deberá ser conocedor de las diversas maneras de constituir una familia, del derecho a elegir o no pareja, y de la significación de estas prácticas en la vida de las personas y los grupos, porque todo ello deberá ser incorporado en su intervención con la constante defensa de los Derechos Humanos. Ya que el Trabajo Social y los Derechos Humanos están presentes tanto en su propia definición como a lo largo del proceso de intervención: información, asesoramiento, orientación, apoyo, supervisión, seguimiento y evaluación. El texto que sigue hace un recorrido sobre las diferentes formas de matrimonio, concretamente en los aspectos que se refieren al sistema de elección de cónyuge y los motivos que llevan a prestar el libre consentimiento a la unión matrimonial: matrimonio concertado, forzoso, sustentado en el amor y por conveniencia, presentes en nuestro país desde que ha pasado a ser receptor de personas inmigrantes. Para ello se expone la realidad de cada uno de ellos, el marco jurídico que los refrenda y ampara, así como el contexto en el que surgen y se desarrollan. Se ha realizado una revisión bibliográfica en un intento de reflexionar sobre estos sistemas matrimoniales y las consecuencias sociales y jurídicas que pueden tener para los contrayentes y para la práctica profesional del trabajador social.
