Abstract
Abstract This chapter discusses Article 164 TFEU, which provides the legal basis for the adoption of legislation relating to the European Social Fund (ESF). It explores how Article 164 TFEU allows the European Parliament (EP) and Council to adopt implementing regulations in which the rules specific to the ESF are set out. It also highlights the ESF+ Regulation that sets out the mission and scope of support of the ESF+, which inter alia integrated the former ESF. The chapter reviews the ESF+ Regulation, which requires that in their programmes under the shared management strand the Member States (MS) prioritise interventions that address the challenges identified in the European Semester. It analyzes the horizontal financial rules adopted by the EP and the Council on the basis of Article 322 TFEU that apply to the ESF+ Regulation.
