Abstract

After the arrival of Venezuelan migrants to Colombia on a regular and irregular basis, it has caused a significant modification and implementation of normative instruments regarding labor issues such as: access to work, social security, immigrant status, among other related tools in matters of employment. guarantees for workers. This has caused foreigners who migrated to Colombia irregularly and who have not legalized their documents and / or permits in our country have a series of difficulties, among which is access to a job through a labor contract, and consequently, they cannot make their contributions to the social security system. All this, because they do not have the official protocol, nor the financial support to make their respective contribution to the social security system. Migrants in an irregular condition have been forced to have to work independently, a job in which the majority do not earn even the minimum wage, and affects the contribution to the social security system, a situation for which they choose to join. to the subsidized health regime, however, this subsidized affiliation is prior to the fulfillment of a series of requirements.
