Pada Orde Lama (Soekarno) dan Orde Baru (Soeharto) perdebatan penerapan syari'at Islam tertutup, terutama setelah keluanya Dekrit Presiden 1959 serta kebijakan negara (Orde Baru) untuk menjadikan Pancasila sebagai satu-satunya asas bernegara. Di kalangan muslim sendiri penerapan syari'at Islam di perdebatkan. Sebagian mendukung dan sebagian menolak. Dukungan terhadapnya disuarakan oleh Islam garis keras, sedangkan Islam liberal menolaknya.

This research aims to analyze the effect level of inflation, transaction of interbank sharia money market and sharia investment to yield sharia certificate of Bank Indonesia period January 2012 - December 2017. The data used are time series data period January 2012 - December 2017 published by BI and OJK. The method of analysis used in this research is Vector Auto Regression (VAR) models. Results of Granger Causality analysis show that, there is a pattern of one-way causality between inflation with transaction of interbank sharia money market (PUAS) and yield sharia certificate of Bank Indonesia (SBIS), there is a pattern of one-way causality between sharia investment with transaction of interbank sharia money market (PUAS) and there is not a pattern of one-way causality between yield sharia certificate of Bank Indonesia (SBIS) with transaction of interbank sharia money market (PUAS) and sharia investmentin Indonesia period 2012-2017. Results of Impulse Response Function analysis show that, inflation response most quickly reach stability when shock occur in the variable transaction of interbank sharia money market (PUAS). Transaction of interbank sharia money market (PUAS) response most quickly reach stability when shock occur in the variable sharia investment. Sharia investment response most quickly reach stability when shock occur in the variable sharia investment. Yield sharia certificate of Bank Indonesia (SBIS) response most quickly reach stability when shock occur in the variable transaction of interbank sharia money market (PUAS). Result of Variance Decomposition analysis show that, the variable that gives the most contribution to inflation, transaction of interbank sharia money market (PUAS), sharia investment and yield sharia certificate of Bank Indonesia (SBIS) is inflation, transaction of interbank sharia money market (PUAS), sharia investment and yield sharia certificate of Bank Indonesia (SBIS) it self.

As the times, talk about sharia become an arena of heated debate in the discourse of Islamic thought. That's because sharia is understood formally-textual so often seen as not in conformity with the context of the times and changes. Though true sharia is a concept that also accompanies the development of civilization and humanity as a goal makes. This paper discusses one of the thought leaders who participated actively in the reform of Islamic law, ie, Muhammad Said al-Ashmawi, a former judge in Egypt. He comes to offer a few thoughts reconstruction of Shari'a that the effect is very positive for the development of Islamic legal thought appropriate to the context of today. According to him, there is an understanding of the Shari'a that needs to be clarified. The substance is related to the humanitarian and welfare, and it is more important than istilling symbols on the walls of the Shari'a legal-formal state legislation. So that needs to be used as a reference in its application is the maqashid ash-Shariat (the purposes of its own Shari'a). Research on al-Ashmawi thinking this could be a reference to be used as an argument or a slightly different view, so when looking at the context that occurred in Indonesia, al-Ashmawi thinking this could be a discourse of new thinking.

This study aims to: (1) Analyze financial performance. Bank Negara Indonesia Tbk. in 2010-2014, (2) analyzing financial performance. Bank Negara Indonesia Syariah Tbk. in 2010-2014, (3) to analyze the differences in the financial performance of conventional banks and Islamic banks in the PT. Bank Negara Indonesia Tbk. 2010-2014. This research is a kind of causal comparative research. Population in this research is PT. Bank Negara Indonesia Tbk. and PT. Bank Negara Indonesia Syariah Tbk. The sample in this research is financial statements from 2010-2014 PT. Bank Negara Indonesia Tbk. and PT. Bank Negara Indonesia Syariah Tbk. This study uses secondary data. Secondary data in this study were obtained from the annual financial report of PT. Bank Negara Indonesia Tbk. and PT. Bank Negara Indonesia Syariah Tbk. on during the period 2010-2014 that has been audited and publicized to the public via the official website of PT. Bank Negara Indonesia Tbk. and PT. Bank Negara Indonesia Syariah Tbk. This research assessment system uses a quantitative approach. Quantitative approach carried out by calculating financial ratios and the ratios are NPL, LDR, ROA, And CAR which is then followed by different test by using statistical test Independent Sample t - Test. The results showed that there were significant differences in financial performance between conventional banks and Islamic banks during the period 2010-2014. In general, in terms of liquidity, profitability, and capital of the Bank Negara Indonesia's financial performance is better than the Bank Negara Indonesia Syariah. Bank Negara Indonesia Syariah only have better asset quality of the Bank Negara Indonesia.

The crisis in 2007 which originates from the state of the united states have an impact on the banking sector in indonesia . Banking is the financial sector that is not in spite of the impact of the financial crisis global. In october 2009, three general bank conventional namely bank mandiri, bank negara indonesia, and bank rakyat indonesia liquidity assistance asked of each government 5 trillion rupiah (bank indonesia , 2009 ) In contrast to general sharia-based bank, during the period of the crisis can still show a business activity is better. The role of a syariah banking continued to increase it looks from the association of community funds that continue to increase from 2007 until years 2013. The condition of islamic banking industry in indonesia seen from the growth of third party funds, market share to the total third party funds indonesian banking, the performance of return on assets, office network development, and the number of workers kerjasudah fairly stable from the period 2007 to 2013 period . The development of syariah banking industry it can ’t be good , there is still seen the gap between structural of syariah bank , where 2 bank controls more than 20 percent market share of total share of the third party funds syariah banking overall. The purpose of this research is analyzing the structure of the market in islamic banking industry in indonesia, analyse the influence on the performance of syariah bank market structure, and analyze the influence of behavior on the performance of syariah bank market in indonesia 2011-2014 year. The analysis used in this research is a method of data panel with simultaneous equations. This research result indicates that islamic banking industry in indonesia oligopoli presently, simultaneously the structure of markets influences behavior and conduct market effect on the performance of syariah bank market in indonesia 2011-2014 in the period .

The existence of syariah banking in Indonesia was thought about because of monetary crisis in 1997 as well as national political crisis. They had brought impact and influenced national economy. Such crisis has already given inspiration to bring up out of the alternative bank which could be developed in Indonesia, such as syariah banking. The research has shown that syariah bank can survive from monetary crisis, so the existence of syariah banking is hoped to become one of reliable banks. Nevertheless, in order to make syariah banking survive with its characteristic, the law enforcement of syariah banking requires more selective supervision of Bank Indonesia and needs to be supported by excellent human resources. Finally, syariah banking can still be trusted by society, and becomes one of alternative bank in Indonesia.<br /><br /><strong>Keywords: monetary crisis; syariah banking; law enforcement</strong>

Shari’a compliance is important element and basic for financial business which based on sharia. The growth of multidiversity of financial business which based on sharia in Indonesia should be blessed. First, the character of sharia element which is applied as the basic of business is very universal to the benefit of humankind. It means that the element is fair to any kind of religion of every individual who deals with business. Second, Indonesian potential as the biggest moslem country in the world. Lastly, an awareness of conventional economic system failure creating crises since 1923, 1930, 1940, 1970, 1980, 1990, 1997, and even until today. Above all, Allah proclaims to conduct business based on sharia clearly stated on Al- Qur’an in surah Al-Jaatsiyah 45:18. Taking the reference on that, it is very clear that in financial business based on sharia should garranty that the products sold or offered are not againts Al Qur’an and Sunnah. That noble assignment is on the responsibility of Board of Sharia Supervisory (Dewan Pengawas Syariah) whose works based on the principle of conventional audit side by side with audit based on sharia as it is instructed by National Board of Sharia (Dewan Syariah Nasional). Banking growth in Indonesia has started to improve, as seen in the financing conducted by sharia banks as well as credit in conventional banks. In the midst of the current crisis, Sharia banking continues to face a very rapid development in the muslim-majority community. Sharia banking is the performance of the Sharia industry in Indonesia where its role has been recognized legally and able to compete with conventional banking. The impact of it all will bring about competition that allows for accelerated repayment especially in terms oftakeovers. This study aims to analyze how financing practices, especially murabahah agreements in sharia banks and if there is a settlement in the accelerated then reviewed with the study of fiqhnya and in ju paired with what happens in conventional banks. This qualitaf research by means of ( Descriptive Analytics) where information is collected using a very in-depth interview method and literature, after that in the analysis until finding conclusions. This study provides the result that murabahah contract financing and repayment in accelerated both in sharia and conventional banking has been in accordance with the requirements and regulations in force, but still needed will be government intervention in the manufacture of regulations to create a more ethical competitive climate, especially that can result in accelerated repayment so that often takeover financing or credit from sharia banks to conventional and vice versa. The implications of this study to share knowledge to the public who still lack understanding between financing, especially murabahah agreement and repayment in accelerated that occurs in Sharia banking. So it is expected to provide in-depth guidance as knowledge to make decisions between sharia or conventional banks in an effort to meet the needs of financing.

Abstract. The purpose of this study to determine how the health level of PT Bank BNI Syariah, Tbk based health assessment methods bank continues to grow, the latest method is a method RGEC. using RGEC in 2012-2014. The soundness of banks measured by financial ratios. These ratios include CAR, NPA, ROA, ROE, NIM, ROA, FDR, NPL, LR, IRR, DR, and facr. This research is descriptive with quantitative approach. The subjects were financial statements of Bank Negara Indonesia Sharia. The objects used in this study are the financial statements of Bank Negara Indonesia Syariah 2012-2014. Data collection techniques in this research that is by downloading the financial statements of the official website of the State Bank Indonesia Sharia. The analysis technique used is the method RGEC to determine the soundness of a bank are classified into health ratings of banks. The results of this research note that for Rating Bank Negara Indonesia Syariah using RGEC shows predicate health of the bank in accordance with the standards set by Bank Indonesia, for the period of December 2012, December 2013, up to December 2014 the average Bank Negara Indonesia HEALTHY Sharia predicate, so that the performance of Bank Negara Indonesia Sharia should be maintained by preserving the soundness of banks. Bank Negara Indonesia Sharia can improve the ability of assets, capital management, as well as operating income, so the quality of bank profits can be maintained and even improved.

In the past twelve years, Aceh government in Indonesia has taken serious action in regulating the society by injecting Islamic laws into the regional laws. By the way of operating these laws into the city, the local government not only put prohibition billboard around the cities, regulating dress codes and limited time access to the parks, but also hire Sharia polices to patrol cities for religiously undesirable behaviors in the public space. If the offenders get caught, they will be taken to the Islamic court and threaten by paying fine, caning, or even imprisoning. A previous research by Center for the Study of Religion and Culture(CSRC) and local media have begun raising the questions on the possible impact Sharia law has on the sense of safety in the public space. This research explores, in particular, the impact of Sharia law on the sense of safety among different social groups. The following research questions are identified: (1) what in public spaces make people feel safe and unsafe because of law impact? (2) does Sharia law affect the comfortableness of the people in the public space? (3) does Sharia law related control mechanisms change people’s behavior in the public space? (4) which group of people directly feel Sharia law impact on the sense of safety? Several methods for data collections are employed, including archival research, elite interviews, field observations and questionnaire to reveal both tangible and intangible factors that influence people’s feeling on the sense of safety in relationship to the Sharia law. The result from survey was analyzed by T-Test and one way analysis of variance (ANOVA) shows how social groups feel differently regarding the Sharia law related-control mechanisms. This research found that (1) male are dislike about the limited time access to the park at night then female;(2) unmarried people feel less comfortable about the dress code than married; (3) college students dislike Sharia police patrol than any other age groups. Overall, the control mechanisms also changed the way people behave in public space to be more acceptable to Muslim society.

At the present day, Islamic banking and finance industry experience a massive growth in a lot of countries including Indonesia. In Indonesia, Islamic banking which commonly known as syariah bank still in the process of develops and promotes its system while the market in Indonesia is growing continuously. Considering the behavior of customer in developing marketing and operational strategy is very important in business. Therefore, this research investigates the relationship effect of corporate reputation on post purchase intention in syariah bank in Indonesia, considering the role of customer trust, customer identification, customer commitment, and knowledge as moderating variable. This study conducted in Indonesia, and collected 245 data. Nine hypotheses were developed during this study, and tested using structural equation model. The findings in this study found that customer commitment is the strongest factor influence post purchase intention. This research also indicates that religion is the strongest key factor that influences customer commitment. Therefore, this finding can be used as input for syariah bank in Indonesia to develop their marketing strategy.

Sharia Banking Act is the crystallization of the long struggle of the Muslims of Indonesia in implementing the principles of Shari'ah in muamalah, especially muamalah maliyah. Realization of Shariah principles in Shariah banking system should refer to the three fundamental principles, namely: 1) the principle of fairness, 2) avoid activities that are prohibited shari'ah, and 3) the aspect of expediency. That the principles of the Shari'ah can be realized well in Sharia banking, then there must be control by the Shariah Supervisory Board (DPS). Shariah Supervisory Board (DPS) is an independent body that was placed by the National Sharia Council (DSN) on the banking and financial institutions Shari'ah. Gait Sharia Banking Council (DPS) in the realization of the principles of Shari'ah in Shariah banking can be seen from the role and functions of the Shariah Supervisory Board in Sharia banking, which provide guidance, ideas, suggestions and advice to directors Islamic banks on matters pertaining to sharia aspects and examine, inspect, examine and assess the implementation of the operational DSN fatwa on Islamic banks. The inflation rate in Indonesia affects the circulation of money. This certainly can be specifically linked to investors' appetite for sukuk. Aside from the macro-economic factors, interest of investors can also be seen from the circulation of money at this time when the dollar rises. Thus, the author would like to associate circulation of money in the present which impact on the level of inflation with the interest of investors to purchase the retail sukuk in the city of Bandung, especially investors in BSM KC Ahmad Yani. Based on the background of the problem, the formulation of the problem and research objectives cover the inflation in Indonesia 2013 - 2015, customer interest in the product retail sukuk series 004 in the Bank Syariah Mandiri branch Ahmad Yani 2013 -2015, and the effect of inflation on customer interest in the product Retail Sukuk Series 004 at Bank Syariah Mandiri Branch Office Ahmad Yani. The research method used by writer is a verification method. Verification method is intended to test the truth of a hypothesis or a phenomenon that is done through data collection in the field. In this case, the verification study aims to determine the effect of the inflation rate in the city of Bandung to investors conducting investment in investment instruments Retail Sukuk in Bank Syariah Mandiri branch Ahmad Yani Bandung. The conclusion of this study showed the inflation rate in Indonesia in the period 2013 - 2015 fluctuated. The customers 'interest in the product retail sukuk series 004 Bank Syariah Mandiri branch Ahmad Yani year period from 2013 to 2015 was very volatile, and the inflation rate in Indonesia in the period 2013-2015 affect the interest of customers' interest in the product of sukuk retail serie 004 of Bank Syariah Mandiri branch Ahmad Yani.

Law No. 7/1992, the law No. 10 /1998 and the law No. 23/ 1990 actually has become a strong legal basis for holding syariah banks in Indonesia, although there are still some things that still need to be perfected, including the need for arranging and enhancements to the terms of the legislation regarding be syariah banks separately so that when there was a dispute in this relation with syariah banking can be resolved by reference to the applicable law. At the beginning which become the problems of the law for the settlement of disputes of syariah banking is about to be brought where the solution, because the Court did not use the syariah as the legal basis for the settlement of the matter, while under the jurisdiction of the Court when it according to Act No. 7 1989 only limited to judge things marriage, inheritance, guardianship, grants, endowments and shadaqoh. So then to anticipate emergency condition then established Convenient Arbitration Indonesia (BAMUI) established jointly by the office of the General Attorney ofthe Republic of Indonesia and the MUI. There is a debate about the quality of service with trust bank syariah customers to syariah banking in applying the syariah principle, so regarded need to be researched about howquality of the service of syariah banks able to build customer satisfaction and trust. Fatmah (2007) found that affects the customer on syariah commercial banks in East Java was the quality of the service. In contrast to the research from Al – Hawari (2011) who does not find a direct relationship between the quality of services with trust. Gounaris and Venetis (2002) found that not all factors have influence on the quality of service trust. This studi was conducted to find out how the levels of trust customers of the bank syariah in applying the principles of syariah analyze the role of the quality of services of a trust customers and the role of customer satisfaction as variable mediation influence the quality of service of a trust. The research was done to the three syariah banks they were Bank Syariah Mandiri, BRI Syariah banks and Bank Syariah BNI, with samples from 150 customers by applying a technique accidental sampling method. Research variable divided into 2 namely endogenous variable that is the quality of service, while endogenous variable is satisfaction customers and trust. Data collection technique uses a questionnare that arranged in Likert sclae 5 point, while data analysis techniques use Path Analysis. The analysis shows that quality of services and not directly influence on customer trust. Professional service quality on one side of syariah bank customers will strengthen confidence, in the other side will from the creation of customer satisfaction, the satisfaction of customers will strengthen confidence of the bank syariah customers.
