Abstract

Within the scheme of international law of the 19th Century, the Indian sovereignty was contested. The British colonisers argued that they were the Indian sovereign since as early as 1803. This paper argues that it were the Mughals who had Indian sovereignty, at least till 1858. It was in 1858 that the last Mughal Emperor was removed from Delhi and the British Queen appropriated Indian sovereignty through a 'proclamation'. The paper will discuss how, through legal manoeuvre, Indian was made a 'colony'. It will show the actual position of the Mughals within the Family of Nations, an exclusively European club.
